<br />SECTION 3. CITY RESPONSIBILITIES <br />A. The CITY shall enforce its subdivision regulations, including reVIew and <br />approval processes and design and construction standards, within the CITY's <br />ETJ. With respect to design and construction standards for roads, drainage <br /> <br />and sidewalks, the CITY's standards shall apply except for a proposed <br /> <br />subdivision in which 1) all lots are greater than five acres in size, 2) all lots <br /> <br />have direct access to a public road or street, and 3) no public improvements <br /> <br />are required to be dedicated under CITY or COUNTY standards. In the case <br /> <br />of subdivisions within this exception, the COUNTY's design and construction <br /> <br />standards for roads, drainage and sidewalks shall apply, provided that the lots <br /> <br />in the subdivision shall be prohibited by recorded deed restriction from being <br /> <br />resubdivided to create any lot less than five acres in size. CITY design and <br /> <br />construction standards shall apply to water and wastewater utility systems in <br /> <br />all subdivisions. The CITY may authorize variances from design and <br /> <br />construction standards in accordance with criteria and procedures in <br /> <br />applicable CITY ordinances. Where public sidewalks are constructed in a <br /> <br />subdivision in the CITY's ETJ, the developer shall record a deed restriction <br /> <br />that requires property owners to maintain the portion of the sidewalk abutting <br /> <br />the respective lots in a safe and durable condition. <br /> <br />B. The COUNTY expressly delegates to the CITY the authority, in accordance <br /> <br />with the COUNTY's subdivision regulations, to require the preparation of a <br /> <br />subdivision plat for the division of any property into two or more lots if any <br /> <br />lot in the subdivision is 10 acres or less in size. <br /> <br />4 <br />
