2.6 Designate Jennifer Shell, P.E., Interim CIP Director, as the City's Project Manager and <br />authorized representative to act on the City's behalf with respect to this Agreement. The City <br />will examine the documents and information submitted by the Consultant and promptly render <br />responses to the Consultant on issues requiring a decision by the City. <br />2.7 Provide access to and make all necessary provisions for the Consultant to enter public <br />and private property as required for the Consultant to perform its services under this Agreement. <br />2.8 Be responsible for the costs associated with preliminary title commitments, title <br />commitment updates and the title insurance. <br />2.9 Bear all other costs incidental to this Article. <br />ARTICLE 3 <br />REIMBURSABLE EXPENSES <br />3.1 Reimbursable expenses, including such things as expenses for plotting, reproduction of <br />documents, auto travel mileage, delivery charges, long distance communications, freight, and <br />state accessibility review are included in the Consultant's basic services compensation. <br />ARTICLE 4 <br />PAYMENTS TO THE CONSULTANT <br />4.1 PAYMENTS FOR BASIC SERVICES <br />The City will pay the Consultant for Basic Services monthly following receipt by City of <br />Consultant's invoices showing direct and indirect labor costs, expenses for materials and <br />supplies and any other reimbursable expenses if applicable, and appropriate payment <br />requisitions. The Consultant will base the amounts of these invoices on the extent of work it has <br />completed on an hourly basis within each task, in accordance with Article 13 of this Agreement, <br />less any disputed amounts, pending resolution thereof. <br />4.2 PAYMENTS FOR ADDITIONAL SERVICES <br />Payments on account of the Consultant's Additional Services as defined in Section 1.6 will be <br />made monthly upon presentation of the Consultant's statement of services rendered or expenses <br />incurred, less any disputed amounts, pending resolution thereof and an Authorization of Change <br />in Services form executed by the Consultant and the City. <br />ARTICLE 5 <br />CONSULTANT'S RECORDS <br />5.1 The Consultant will keep all of its expense records in a recognized accounting format <br />acceptable to the City and these records will be available to the City at mutually convenient <br />times. <br />5.2 The City, its auditors, federal auditors, and state agencies that have monitoring or <br />HDR- Victory Gardens Acquisition —North Phase 4/25/11 <br />6 <br />
