1.6 ADDITIONAL SERVICES /CHANGE IN SERVICES <br />1.6.1 The City may direct the Consultant to perform services outside of the scope of the Basic <br />Services described in Sections 1.1 through 1.5 above. The Consultant will submit a written <br />estimate of fees to the City and obtain the City's authorization before initiating any additional <br />services. Consultant services required due to changes to any parcel including but not limited to <br />plan changes, splits of the parcel, re- appraisal, plat changes, survey changes, or other changes <br />that are required through no fault of the Consultant or are beyond the control of Consultant are <br />considered additional services. <br />1.6.2 Each material change (deletion or addition) in the services to be provided by Consultant <br />must be authorized by the City on the Authorization of Change in Services form attached to this <br />Agreement as Attachment A. Compensation for additional services will be in addition to that <br />specified for Basic Services in accordance with Article 13 of this Agreement. The approval of <br />the San Marcos City Council is necessary for all additional services the compensation for which <br />exceeds $50,000.00. <br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br />The City will: <br />2.1 Provide full information to the Consultant regarding the City's requirements for the <br />Consultant's services under this Agreement. The City will furnish the Consultant with copies of <br />data and information in the City's possession needed by the Consultant at the Consultant's <br />request. In addition, the City will provide the Consultant with accurate land descriptions <br />(including parcel plats and field notes), available information about the Project, title information <br />and any other applicable information. For the duration of this Agreement, the City will provide <br />the Consultant with accurate and timely information regarding the details of right -of -way <br />acquisition offers or settlements that may be made by the Consultant, including keeping the <br />Consultant informed of any changes in the permissible terms of offers or settlements. <br />2.2 Provide limited title certificates, title services, title reports and/or commitments, policies, <br />closing and escrow services through an agreement with Independence Title Company located in <br />San Marcos, Texas. The City will pay for any title expenses. <br />2.3 Provide approval of appraisals submitted by Consultant that will be the basis for making <br />offers to the property owners. <br />2.4 Respond to the Consultant concerning inquiries from real property owners in a prompt <br />and timely manner. In addition, the City will immediately inform the Consultant in writing of <br />any changes in the policies, procedures, or agreements affecting the City that would have any <br />impact on the negotiation for the purchase of the required property interests. <br />2.5 Be responsible for all eminent domain proceedings except those specified in Section <br />1.4.5. <br />HDR- Victory Gardens Acquisition —North Phase 4/25/11 <br />5 <br />
