Sesquicentennial 185 May 20, 2002 Dan O'Leary 517 Northwest Hills Road San Marcos, TX 78666 Dear Mr. O'Leary: This letter will serve as the agreement between the City of San Marcos, Texas and you for your temporary employment as Interim City Manager of the City of San Marcos. The term of this agreement will begin on June 8, 2002, and will end on the date that a new City Manager begins working for the City, unless sooner terminated by either party. A. FUNCTIONS AND DUTIES You agree to use your best efforts to perform the functions and duties of the City Manager as the chief administrative and executive officer of the city, and to be responsible to the City Council for the administration of all the affairs of the City. Your duties and functions will include, without limitation, the following: 1. To appoint and remove employees of the City, except where such authority is reserved to the City Councilor otherwise prescribed by the City Charter or by state law. 2. To supervise, direct and control all administrative units of the City, except those supervised by other appointees of the Council. 3. To prepare and submit the annual budget to the City Council in accordance with the requirements of the Charter and state law. 4. To keep the City Council fully advised of the financial condition and needs of the City. 5. To recommend to the City Council for action such administrative measures as you deem necessary or expedient. 6. To perform other duties as provided by the Charter, City ordinances or other laws, and as prescribed by the City Council. B. GENERAL RESPONSIBILITIES 1. You will report and be directly responsible to the City Council.
