On May 28, 2002, the City Planning and Zoning Commission held a public hearing <br />regarding a request to change the zoning from "PD" Pre-Development District to "PDD" Planned <br />Development District for a 103.89 acre, more or less, tract of property (the "Rezoning Area") located <br />in the 2200 Block ofIH-35 North, and a request to amend the future land use map of the City Master <br />Plan to designate a 25.6 acre, more or less, tract of property (the "Land Use Amendment Area") <br />adjacent to the Rezoning Area as "OS/F" Open Space/Floodplain. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, <br />on May 28,2002, consider and vote to deny the request, and has recommended that the request be <br />denied by the City Council of the City. <br /> <br />3. The City Council held public hearings regarding the request on June 24,2002 and July <br />8, 2002. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments, and of Article 5 of Chapter 94, Development Standards, of the San Marcos <br />City Code pertaining to planned development districts, have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following ordinance <br />is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the <br />San Marcos City Code, is amended to rezone the following real property which is presently zoned <br />"PD" Pre-Development District to "PDD" Planned Development District: <br /> <br />Street address: 2200 Block ofIH-35 North <br />
