Size: 103.89 acres, more or less Legal description: The 129.49 acre, more or less, tract of property comprised by the 66.12 and 63.37 acre, more or less, tracts of property described in the metes and bounds descriptions attached as Exhibit A-I and Exhibit A-2, save and except the 25.6 acre, more or less, tract of property described in the metes and bounds description attached as Exhibit A-3. Deed or plat reference: Volume 87, page 217 and Volume 1045, Page. 121, Hays County Deed Records. SECTION 2. The base zoning districts for the Rezoning Area are established in accordance with the map attached as Exhibit B. SECTION 3. The development standards for the Rezoning Area and the Land Use Amendment Area, attached to this ordinance as Exhibit C, are approved and adopted to govern the future development of the Rezoning Area and the Land Use Amendment Area. SECTION 4. The future land use map of City, included in the Horizons City Master Plan adopted in City Code Section 102.026, is amended to conform to the rezoning described in Section 1 of this ordinance, and to designate the Land Use Amendment Area as "OS/F" Open Space/Floodplain. SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor and is subj ect to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 6. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
