• ORDINANCE NO. 2011- 0 8 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, PERTAINING TO TWO CONTIGUOUS TRACTS OF <br />LAND OUT OF THE J.M. VERAMENDI SURVEY NO. 2, ABSTRACT <br />NO. 17, LOCATED ON TELLURIDE STREET NEAR POST ROAD; <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP <br />FROM "C" COMMERCIAL TO "MDR" MEDIUM DENSITY <br />RESIDENTIAL FOR AN 8.38 ACRE, MORE OR LESS, TRACT OF LAND <br />AND FROM "HDR" HIGH DENSITY RESIDENTIAL TO "MDR" <br />MEDIUM DENSITY RESIDENTIAL FOR A 9.87 ACRE, MORE OR LESS, <br />TRACT OF LAND; AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING SAID 8.38 ACRE TRACT FROM "GC" GENERAL <br />COMMERCIAL DISTRICT TO "MF -12" MULTIPLE - FAMILY <br />RESIDENTIAL DISTRICT AND SAID 9.87 ACRE TRACT FROM "FD" <br />FUTURE DEVELOPMENT DISTRICT TO "MF -12" MULTIPLE - <br />FAMILY RESIDENTIAL DISTRICT; AND INCLUDING PROCEDURAL <br />PROVISIONS <br />RECITALS: <br />1. On February 22, 2011, the Planning and Zoning Commission of the City of San <br />• Marcos held public hearings regarding requests pertaining to two contiguous tracts of land on <br />Telluride Street near Post Road to change the Future Land Use Map of the San Marcos Horizons <br />City Master Plan from "C" Commercial to "MDR" Medium Density Residential for an 8.38 <br />acre, more or less, tract of land ( "Tract A ") and from "HDR" High Density Residential to <br />"MDR" Medium Density Residential for a 9.87 acre, more or less, tract of land ( "Tract B "), and <br />concurrent requests to change the zoning for said Tract "A" (8.38 acres) from "GC" General <br />Commercial District to "MF -12" Multiple- Family Residential District and to change the zoning <br />for said Tract "B" (9.87 acres) from "FD" Future Development to "MF -12" Multiple - Family <br />Residential District. <br />2. Subsequent to the public hearings on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on February 22, 2011, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on March 24, 2011 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />is <br />
