from the real property owner(s) including supporting documentation and the Consultant's <br />recommendation with regard to administrative settlements. <br />1.5.7 Advise and provide expert witness testimony as requested. <br />1.5.8 As requested by the City, prepare written notification to the City of any environmental <br />concerns associated with the real property to be acquired, which may require environmental <br />mitigation/remediation. <br />1.6 TASK 6— CLOSING SERVICES <br />The Consultant will: <br />1.6.1 Coordinate with the City and title company to obtain an updated title commitment along <br />with other forms and a certified copy of the instrument of conveyance necessary when requesting <br />the parcel payment from the City. <br />1.6.2 Attend closings and provide closing services in conjunction with the title company. <br />1.6.3 Ensure that the title company records all original instruments immediately after closing in <br />the respective County Clerk's Office including donation agreements. The Consultant will <br />deliver an executed easement document to the City if not being provided by the title company. <br />1.7 ADDITIONAL SERVICES /CHANGE IN SERVICES <br />1.7.1 The City may direct the Consultant to perform services outside of the scope of the Basic <br />Services described in Sections 1.1 through 1.6 above. The Consultant will submit a written <br />estimate of fees to the City and obtain the City's authorization before initiating any additional <br />services. Consultant services required due to changes to any parcel including but not limited to <br />plan changes, splits of the parcel, re- appraisal, plat changes, survey changes, or other changes <br />that are required through no fault of the Consultant or are beyond the control of Consultant are <br />considered additional services. <br />1.7.2 Each material change (deletion or addition) in the services to be provided by Consultant <br />must be authorized by the City on the Authorization of Change in Services form attached to this <br />Agreement as Attachment A. Compensation for additional services will be in addition to that <br />specified for Basic Services in accordance with Article 13 of this Agreement. The approval of <br />the San Marcos City Council is necessary for al l additional services the compensation for which <br />exceeds $50,000.00. <br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br />The City will: <br />2.1 Provide full information to the Consultant regarding the City's requirements for the <br />LAN -North LBJ — Sessom to Holland and 12" Waterline Project Final <br />5 <br />
