<br />:E (/) <br />C'.1 0 <br />:;1j (,) <br />C> ~ ... <br />o~ C> a;CU <br />C'.1 w~ <br />W~ N ....Je <br />..Jo e Ucu <br />iIfJ >CJ) <br /> .....- <br /> -0 <br /> 0>, <br />!< - <br /> (3 <br /> <br />116. <br /> <br />ORDINANCE NO. 2002- 46 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS REVISING AND UPDATING <br />PORTIONS OF ARTICLE 3, DRAINAGE AND EROSION <br />CONTROL, OF CHAPTER 94, DEVELOPMENT <br />STANDARDS, OF THE CITY CODE; AMENDING CHAPTER <br />110, SUBDIVISIONS, OF THE CITY CODE TO ADD A <br />REFERENCE TO DRAINAGE, EROSION CONTROL AND <br />WATER QUALITY REGULATIONS; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN <br />EMERGENCY. <br /> <br />RECIT ALS: <br /> <br />1. The City Council has received recommendations from the Planning and Zoning Commission for <br />interim amendments to the City's drainage and erosion control ordinance provisions, pending <br />completion of the unified development code project currently under way. <br /> <br />2. The City Council wishes to adopt interim amendments to the City's drainage and erosion control <br />ordinance provisions, to improve the quality of stormwater flows into waterways, creeks and rivers <br />in and near the City, and to assist the City and developers in meeting storm water pollution control <br />standards of the U.S. Environmental Protection Agency. <br /> <br />3. The City Council conducted a public hearing on this ordinance on ,11] 1 Y R, <br /> <br />,2002. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The title of Article 3 of Chapter 94 of the City Code is amended as follows (added <br />text is indicated by underlining; deleted text is indicated by overstrike): <br /> <br />Article 3. Drainagel and Erosion Control and Water Qualitv <br /> <br />SECTION 2. Section 94.048(g) of the City Code is amended as follows (added text is indicated by <br />underlining; deleted text is indicated by overstrike): <br /> <br />(g) Water quality detention and sedimentation basins designed to remove stormwater <br />contaminants that are required by article 4 of this chapter, pertaining to the San Marcos River <br />Corridor, and by article 6 of this chapter, pertaining to the Edwards Aquifer, and by chapter <br />110, pertaining to subdivisions, shall be governed required by this article. Plans for these <br />water quality contaminant removal facilities shall be part of the site plans required by this <br />article. Failure to construct and maintain these water quality contaminant removal facilities <br />is a violation of this article.
