<br />SECTION 3. Sections 94.071 and 94.072 of the City Code are amended as follows (added text is <br />indicated by underlining; deleted text is indicated by overstrike): <br /> <br />Sec. 94.071. Permit required for development; application. <br /> <br />(a) It is unlawful for a person, including a subdivider or owner of land, to initiate the <br />development of a tract of property within the city limits or the city's extraterritorial <br />iurisdiction, or begin construction associated with such a development, such as clearing. <br />grading, filling, cutting roads or extending or installing utilities, without first applying for <br />and obtaining a site development permit from the director of engineering. This requirement <br />does not apply to the following: <br /> <br />(1) Clearing that is necessary only for surveying purposes; or <br /> <br />(2) Development of a single-family dwelling or duplex dwelling on a legally platted lot. <br /> <br />(.!2a) l\.ny person desiring a Applications for site development permit~ under this article shall <br />be submitted an application to the director of eity engineeri.!!g, on a form provided by the <br />director city engineer. +he Each application shall be accompanied by a site development <br />plan. <br /> <br />C~B) The application and the plan shall contain the following information: <br /> <br />(I) The date, scale, north point and key plan showing the location of the tract on which <br />the development is to take place. <br /> <br />(2) The existing boundary lines and acreage of the tract on which the development is to <br />take place and the common boundary lines. <br /> <br />(3) A statement of soils conditions drawn from soil survey maps, on-site observations <br />by engineers and/or soils test data, as required. <br /> <br />(4) A topographic map, drawn to a scale of one inch to 100 feet or in an appropriate scale <br />as determined by the city engineer, to display, according to an on-site survey, <br />topographic information and features, including but not limited to faults and features <br />along waterways and sinkholes; the 100-year floodplains, as identified by the Federal <br />Flood Insurance Administration; and manmade and natural drainageways. The <br />topographic map will be prepared using two-foot contour intervals, unless the <br />director of engineering determines another contour interval is appropriate. <br /> <br />CQe) Notwithstanding the requirements of subsection (fB) of this section, the eity director of <br />engineeri.!!g may waive the submission of any information in the application and plan that <br />is not necessary due to the scope and nature of the proposed development. <br /> <br />C:\TEMP\Drainage Interim Amendments.doc <br /> <br />2 <br />
