No plat or construction plans will be approved by the planning and zoning commission or the planning director. and no construction plans will be approved by the director of engineering, and no completed improvements will be accepted by the director of engineering, public works or director of '.'vater and waste'Nater unless they conform to the subdivision design requirements and city standards. (b) Conformity to the comprehensive plan. The subdivision shall conform to the city master plan adopted in section 102.026, as amended comprehensive plan and the parts thereof. (c) Reserve strips prohibited. There will be no reserve strips of land, except those conveyed or dedicated to the government having jurisdiction. (d) Drainage, erosion control and water qualitv. The subdivision shall be designed and constructed in accordance with applicable provisions of Chapter 94 regarding drainage, erosion control and water quality. SECTION 6. All references to "city engineer" contained in Article 3 of Chapter 94 of the City Code are changed to "director of engineering". SECTION 7. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinallce will continue in force if they can be given effect without the invalid portion. SECTION 8. All ordinances or parts of ordinances in conflict with this ordinance are repealed, except that such repealed provisions shall remain in effect for the sole purpose of processing development applications accepted for filing prior to the effective date of this ordinance. SECTION 9. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 10. The importance of this Ordinance creates an emergency and an imperative public necessity, and the provisions of the Charter requiring that ordinances be presented at three separate meetings, and that ordinances do not take effect until ten days after the date of final passage are suspended, and this Ordinance will take effect upon publication of notice of its adoption in a newspaper of general circulation within the City.
