No plat or construction plans will be approved <br />by the planning and zoning commission or the planning director. and no construction plans <br />will be approved by the director of engineering, and no completed improvements will be <br />accepted by the director of engineering, public works or director of '.'vater and waste'Nater <br />unless they conform to the subdivision design requirements and city standards. <br /> <br />(b) Conformity to the comprehensive plan. The subdivision shall conform to the city master <br />plan adopted in section 102.026, as amended comprehensive plan and the parts thereof. <br /> <br />(c) Reserve strips prohibited. There will be no reserve strips of land, except those conveyed <br />or dedicated to the government having jurisdiction. <br /> <br />(d) Drainage, erosion control and water qualitv. The subdivision shall be designed and <br />constructed in accordance with applicable provisions of Chapter 94 regarding drainage, <br />erosion control and water quality. <br /> <br />SECTION 6. All references to "city engineer" contained in Article 3 of Chapter 94 of the City Code <br />are changed to "director of engineering". <br /> <br />SECTION 7. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinallce <br />will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 8. All ordinances or parts of ordinances in conflict with this ordinance are repealed, <br />except that such repealed provisions shall remain in effect for the sole purpose of processing <br />development applications accepted for filing prior to the effective date of this ordinance. <br /> <br />SECTION 9. Any person violating any provision of this ordinance commits a misdemeanor and <br />is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. <br /> <br />SECTION 10. The importance of this Ordinance creates an emergency and an imperative public <br />necessity, and the provisions of the Charter requiring that ordinances be presented at three separate <br />meetings, and that ordinances do not take effect until ten days after the date of final passage are <br />suspended, and this Ordinance will take effect upon publication of notice of its adoption in a <br />newspaper of general circulation within the City. <br /> <br />PASSED, APPROVED AND ADOPTED on <br /> <br />July 8, 2002. <br /> <br />~~~ <br /> <br />Robert B.
