<br />(b) Drainage easements must be at least 25 feet in width for open drainage systems, or 15 feet <br />in width for enclosed drainage systems. <br /> <br />Sec. 94.1!0!). Drainage improvements maintenance criteria. <br /> <br />(a) Drainage improvements constructed or installed under f~ll development ofland required <br />to comply with this article shall be maintained in accordance with meet the following <br />requirements: <br /> <br />(1) Aft dDrainage improvements located in the public rights-of-way that have been <br />accepted by the city will shall be maintained by the appropriate jurisdiction. <br /> <br />(2) All drainage improvements located on private property and publicly dedicated <br />easements shall be maintained by the property owner. <br /> <br />(b) During the course of development under a site development permit, and until final <br />inspection of completed drainage improvements, the permit holder shall provide for the <br />following: <br /> <br />(I) Maintaining of an onsite inspection and repair log for all drainage and erosion control <br />features and facilities required under this article. This log shall be open to inspection <br />by city inspectors at reasonable times. <br /> <br />(2) Maintaining rock covered points of ingress and egress sufficient to permit inspection <br />of all drainage and erosion control features and facilities required under this article. <br /> <br />(3) Daily cleanup of paved streets and of drainage areas impacted by on site or offsite <br />construction. <br /> <br />{0 Duly authorized city inspectors may lawfully enter onto the land or premises where <br />property owners are required to maintain drainage facilities, at reasonable times, for the <br />purpose of inspection of the maintenance required. The director of eity engineeri.!!g shall <br />inspect the premises of each facility approved pursuant to this article at least once per year. <br />Where noncompliance is found, the city shall request in writing that the property owner <br />comply. This notice shall describe the measures required to be taken. If, within 30 days of <br />the period of time specified in the notice, the maintenance required is not accomplished, the <br />city may take one or more of the following actions: <br /> <br />ill bBring an action in a court of competent jurisdiction to require the property owner to <br />accomplish the necessary maintenance. <br /> <br />(2) Perform the required maintenance, bill the property owner for the cost of the <br />maintenance, and record a lien against the property served by the drainage facilities. <br /> <br />SECTION 5.
