<br />195. <br /> <br />RESOLUTION NO. 2002- 152 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AMENDMENT NO.4 TO <br />THE AGREEMENT WITH BFI WASTE SERVICES OF TEXAS, <br />LP TO INCREASE RATES FOR COLLECTION AND DISPOSAL <br />OF RESIDENTIAL SOLID WASTE AND RECYCLABLE <br />MATERIALS; AUTHORIZING THE INTERIM CITY MANAGER <br />TO EXECUTE THE AMENDMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City entered into an agreement (the "Agreement") with Browning-Ferris, Inc. on July <br />29, 1997 (subsequently assigned to BFI Waste Services of Texas, LP ("BFI")), for solid waste and <br />recyclable materials collection and disposal services. <br /> <br />2. The City has requested that BFI extend the Agreement for an interim period to allow for <br />a new request for proposals process for solid waste collection and disposal services. <br /> <br />3. BFI is willing to extend the contract for an interim period as described in the attached <br />Amendment No.4, with rate adjustments based on changes in the consumer price index and an <br />increase in the cost for the recycling center operated by Green Guy Recycling. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached Amendment No.4 to the Agreement is approved. <br /> <br />PART 2. The Interim City Manager, Dan O'Leary, is authorized to execute the attached <br />amendment on behalf of the City of San Marcos. <br /> <br />PART 3. This Resolution is in full force and effect from and after its passage. <br /> <br />ADOPTED on August 12 f 2002. <br /> <br />~~.~- <br /> <br />Robert B.
