<br />196. <br /> <br />AMENDMENT NO.4 <br /> <br />TO THE AGREEMENT FOR SOLID WASTE AND RECYCLABLE MATERIALS <br />COLLECTION AND DISPOSAL BETWEEN THE CITY OF SAN MARCOS, TEXAS <br />AND BFI WASTE SERVICES OF TEXAS, LP <br /> <br />RECITALS: <br /> <br />1. On July 29, 1997, the City of San Marcos, Texas, entered into a contract (the "Agreement") with <br />Browning-Ferris, Inc. (subsequently assigned to BFI Waste Systems of Texas, LP ("BFI")) for solid <br />waste and recyclable materials collection and disposal and related services for the City. <br /> <br />2. The City has requested that BFI extend the Agreement for an interim period to allow for a new request for <br />proposals process for solid waste collection and disposal services. <br /> <br />3. BFI is willing to extend the contract for an interim period as described in the attached Amendment No.4, <br />with rate adjustments based on changes in the consumer price index and an increase in the cost for the recycling <br />center operated by Green Guy Recycling. <br /> <br />AGREEMENT: It is understood and agreed by the parties hereto that the following amendments are <br />incorporated into the Agreement: <br /> <br />1. The period of the Agreement is extended from August 31, 2002 to December 31, 2002. The <br />Agreement will automatically be extended on a month-to-month basis for up to eight months after <br />December 31, 2002, unless the City provides the Contractor with written notice of the City's intent to <br />terminate the Agreement, which will take effect at the end of the first full month that follows the date <br />the notice is delivered. <br /> <br />2.
