(d) If it is determined by a veterinarian that a quarantined animal does not show the clinical signs of rabies at the end of the quarantine period, the local healthrabies control authority will release it to the owner if the owner has paid all fees assessed under this chapter, and if: (1) The owner has a current, valid rabies vaccination certificate for the animCl-l; or ". ,-' (2) The animal is vaccinated against rabies by a licensed veterinarian at the owner's expense at the conclusion of the quarantine. Sec. 6.171. Animals constituting imminent danger. Any animal that is or appears to be rabid, constituting an imminent danger to any person or to any other animal, may be immediately exterminated by a police or animal control officer. SECTION 3. The fees related to the administration of Chapter 6 of the City Code are set as shown on Attachment l, Animal Control Fee Schedule. SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 7. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
