<br />evaluation with the City Council. <br /> <br />B. The City Council and Employee shall define such goals and performance objectives that they determine necessary <br />for the proper operation of the City of San Marcos and in the attainment of the City Council's policy objectives and <br />shall further establish a relative priority among those various goals and objectives, said goals and objectives to be <br />reduced to writing. They shall generally be attainable within the time limitations as specified and the annual operating <br />and capital budgets and appropriations provided. <br /> <br />C. In effecting the provisions of this Section, the City Council and Employee mutually agree to abide by the <br />provisions of applicable law. <br /> <br />Section 9: Work Hours <br /> <br />It is recognized that Employee must devote a great deal of time outside the normal office hours to the business of the <br />Employer, and to that end Employee will be allowed to take time off as he shall deem appropriate during said normal <br />office hours. <br /> <br />Section 10: Outside Activities <br /> <br />Employee shall not spend more than 10 hours per week in teaching, consulting or other non-Employer-connected <br />business without the prior approval of the City Council. <br /> <br />Section 11 : Vacation, Sick, and Military Leave <br /> <br />A. Employee shall accrue and have credited to his personal account, vacation and sick leave at the same rate as other <br />general employees of the Employer. Said vacation and sick leave shall be subject to provisions as outlined in Section <br />4 of this agreement, upon termination of Employee. In addition, if Employee voluntarily resigns as described in <br />Section 5 ofthis agreement, Employer agrees to compensate employee for all accrued vacation and sick leave up to <br />and including the final date of employment. <br /> <br />B. Employee shall be entitled to military reserve leave pursuant to Federal or State law and City of San Marcos <br />policies. <br /> <br />Section 12: Disability, Health, and Life Insurance <br /> <br />A. Employer agrees to put into force and to make required premium payments for insurance policies for life, accident, <br />sickness, disability income benefits, major medical, dental, and dependent's coverage group insurance covering <br />Employee and his dependents. <br /> <br />B. Employer agrees to purchase and to pay the required premiums on supplemental life insurance available through <br />the City's current health and life insurance carrier, in an amount equal to two times the annual gross salary of <br />Employee, with the beneficiary named by Employee. In the event no supplemental life program is available through <br />the City's current carrier, Employer shall provide the same for Employee through another carrier. <br /> <br />C. Employer agrees to provide hospitalization, surgical, and comprehensive medical insurance for Employee and his <br />dependents equal to that provided all other employees ofthe City, and to pay the premiums thereon. <br /> <br />Section 13: Retirement <br /> <br />Employer shall provide for Employee's participation in the retirement plan of the Texas Municipal Retirement System <br />in a manner consistent with all other employees of the City of San Marcos. In addition, Employer shall agree to <br />execute all necessary agreements provided by ICMA Retirement Corporation (lCMA-RC) for Employer's continued <br />participation in said ICMA-RC retirement plan and, in addition to the base salary paid by the Employer to Employee, <br /> <br />'"' <br />.) <br />
