Any applicant that is denied a • <br />reauest for an administrative adiustment may apply or petition for a variance under the <br />applicable provisions of this Code, or, if no variance process is provided for the type of <br />adiustment requested, the applicant may app_ eal the decision of the Planning Director in <br />the same manner for appeals of an official's decision to the Zoning Board of Adiustments <br />under Section 1.2.5.3. <br />SECTION 3. Chapter 1, Development Procedures, Article 6, Platting Procedures, <br />Section 1.6.8.4, Amending Plats, is amended by adding a new subsection (h) to read as follows: <br />(h) Simple Amendment to Plat Agreement <br />(1) Purpose. The purpose of an agreement for simple amendment to plat shall be to <br />provide an expeditious means of develovin2 over a middle lot line between two <br />adiacent lots under the same ownership. <br />(2) Applicability. The procedures for an agreement for simple amendment to plat <br />shall apply only for the purpose of constructins a single structure or buildinL- over <br />a single lot line between two contiguous legally conforming lots. <br />(3) Effect. Upon approval by the Director of Development Services, an agreement for <br />simple amendment to plat may be recorded and is controlling over the recorded <br />plat until such time as the structure or building requiring the simple amendment to <br />plat is destroyed or demolished. 0 <br />(4) Contents. An application for approval of an agreement for simple amendment to <br />plat shall be prepared in accordance with Chapter 1 of the Technical Manual. <br />(5) Decision. The Director of Development Services shall either approve, approve <br />with conditions, or deny the application for an agreement for simple amendment <br />to plat. <br />(6) Criteria for Approval. The Director of Development Services shall decide <br />whether to approve, conditionally approve, or deny the simple amendment to <br />plat application based on the following criteria: <br />The combined area and dimensions of the two contiguous lots shall meet <br />all dimensional standards for a single lot under the City's Land <br />Development Code. <br />b. Both lots must be under the same ownership. <br />C. Both lots must be legally platted whole lots within an existina subdivision. <br />d. An agreement for simple amendment to plat shall not attempt to remove or • <br />modify recorded covenants or restrictions or easements. <br />
