0 ORDINANCE NO. 2011 - 3 0 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTION 14.006 OF THE SAN MARCOS <br />CITY CODE TO ESTABLISH AN EXEMPTION FROM CERTAIN <br />BUILDING AND PERMIT FEES FOR PERSONS REPAIRING OR <br />IMPROVING THEIR HOMES; PROVIDING FOR TWO CITY COUNCIL <br />REVIEWS OF THE ORDINANCE BEFORE THE END OF THIS <br />CALENDAR YEAR; PROVIDING A SAVINGS CLAUSE; PROVIDING <br />FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; <br />DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE <br />DATE. <br />RECITALS: <br />1. The City seeks to encourage residents to repair and improve their homes to <br />maintain the stability and quality of the City's neighborhoods by exempting homeowners from <br />certain building and permit fees. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Section 14.006 of the San Marcos City Code is amended as set forth below. <br />Added text is indicated by underlining. Deleted text is indicated by strikethroughs. <br />See. 14.006. Fees and exemptions from fees. <br />(a) All fees in this chapter are established by city council. <br />(b) The following entities shall be exempt from all fees imposed under this <br />chapter: <br />(1) Non - profit organizations receiving funds from all fees the city through the <br />city's Community Development Block Grant or Human Services <br />programs; <br />(2) The city when using city employees on a construction project of the city; <br />(3) Contractors hired by the city to work on construction projects of the city; <br />(4) San Marcos Reinvestment Corporation and San Marcos Habitat for <br />Humanity when building new affordable single - family residential <br />dwellings; <br />(5) The Housing Authority of the City of San Marcos,' for construction <br />. projects on property owned by it, for low- income housing or <br />administrative offices; and <br />
