(6) Any taxing unit as defined under Section 1.04 (12) of the Texas Tax Code for construction projects having a permitted value of $3,000.00 or less. (c) Residential Home Improvement Exemntion. A person making repairs or improvements to a residential dwelling requirine the issuance of a permit by the city is exempt from the pavment of all applicable fees imposed under this chanter if: (1) such person owns and occupies the residential dwelline: (3) the residential dwelling is desisnated as such person's homestead by the County Appraisal District having iurisdiction. and (4) such person, rather than another third party or contractor, directly performs all work on the repairs or improvements requirinE the issuance of a permit by the city. This subsection (c) will expire on December 31, 2011. SECTION 2. The amendment adopted hereby shall be reviewed by the City Council on or before September 30, 2011 and on or before December 31, 2011 to determine its effectiveness in encouraging residents to repair and improve their homes and whether the expiration date stated in the amendment should be extended. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this Ordinance are repealed. SECTION 5. The importance of this Ordinance creates an emergency and an imperative public necessity, and the provisions of the Charter requiring that ordinances be presented at two separate meetings is suspended, and this Ordinance will take effect immediately upon adoption.
