<br />SAN MARCOS ELECTRIC UTILITY <br />ELECTRIC RATE SCHEDULES <br /> <br />OUTDOOR AREA LIGHTING <br />Rate Schedule - OAL <br /> <br />Effective: February 1, 2003 <br /> <br />Page 2 <br /> <br />Any and all amounts not paid before the penalty date shall be assessed a charge in the amount of 10% of the unpaid <br />amount. <br /> <br />Payments from state agencies must be received within 30 days from receipt of bill, and any unpaid amount will be subject <br />to a 1.0% per month interest charge following the procedures set forth in the Prompt Payment Act. <br /> <br />SPECIAL CONDITIONS <br /> <br />The City will furnish, operate and maintain the facilities required for service under this rate schedule. Service at locations <br />where existing City System poles and facilities are not available will be made at the discretion of the City and at an <br />additional charge to recover the cost of installing poles and conductors and to recover increased cost of maintenance. <br /> <br />The following conditions shall apply to all facilities installed by the City under this rate schedule: <br /> <br />The cost of repairing facilities damaged by acts of vandalism shall be billed to the Customer at actual cost to the <br />City including all appropriate overheads. <br /> <br />The City shall, at the request of the Customer, relocate or change existing equipment and the Customer shall <br />reimburse the City for any and all such relocations or changes at the City's actual costs including all appropriate <br />overheads. <br /> <br />Extensions of any lighting facilities will be made by the City only where, in the sole opinion of the City, the annual <br />revenues justify the estimated costs including all appropriate overheads. <br /> <br />New private area lighting facilities shall be of a form and substance consistent with the City's approved standard <br />configuration for private area lighting at the time of the Customer's application for service. Where a non-standard <br />lighting configuration is requested by the Customer, all maintenance and replacement costs shall be paid by the <br />Customer should the City agree to the installation of the non-standard facilities. <br /> <br />TERM OF CONTRACT <br /> <br />Customers requesting service under this rate schedule will be required to execute a standard contract for service with a <br />minimum term of 36 months. <br /> <br />INTERRUPTION OF SERVICE <br /> <br />The City will make reasonable provisions to ensure satisfactory and continuous service, but does not guarantee a <br />continuous supply of electric power and energy from the City System facilities and shall not be liable for damage <br />occasioned by interruptions of service or failure to commence delivery caused by acts of God, or the public enemy, or for <br />any cause reasonably beyond the control of the City, including, but not limited -to, the failure or breakdown of facilities, <br />floods, fire, strikes, or actions or orders of any agency having jurisdiction in the premises, or for interruptions which are <br />necessary for inspection, repair, or changes in the equipment and facilities of the City, the City System or the bulk power <br />supplier(s) to the City System. The Customer shall notify the City immediately of any defect, trouble or accident which <br />may in any way affect the delivery of electric service by the City from the City System. <br /> <br />C:\TEMP\Electric Utility rate schedules- 11-02.doc <br />
