LCRA owns and operates an electric generation and transmission system in the centBl <br />Tass region, which system includes tt3J1smission lines. real property, and rights orway owned or <br />controlled by LCRA. together with a telecommunications network consisting of fiber-optic cable <br />and microwave radio paths. constructed to suppon the electric system; <br /> <br />Whereas, it is in the best interest ofLCllA's customers and the public to license reserve capacity <br />in its fiber-optic communications and microwave network to its customers and public entities until <br />such capacity is needed for LCRA use; and <br /> <br />Whereas, Licensee desires to ~e part of the r~c c:apacity, to install and operate <br />communitation~ equipment on LCRA property. and to provide Ucensee's communications <br />ser~ices through the Segment Route; <br /> <br />No~', therefore, in consideration of the mutual obligations and benefits oftrus Agreement, the <br />Parties agree as follows: <br /> <br />1. ~ovision ofC~aci~. LCRA shall provide single T-l capacity to Licensee along the Sesment <br />Route from the Commencement Date until termination of this Ucense. LCRA shall desigl\ite the <br />demarcation points at each end of the Segment Route. <br /> <br />2. M~enance Q(System. LCRA shall procure, install, operate. and maintain the Sy5tem and <br />the electronic equipment supporting the provision of capacity between the designated demarcation <br />points throughout the term of this Agreement. Only LCRA or its contractors ~I perfonn aU <br />work on the System, transmission or microwa~ towers, stNctuTeS, electric substations, or other <br />LCRA-owned Of' ~ntrollcd property. <br /> <br />3. eayment ofFeesIJcrm.
