Milestone Dates means project milestone dates which are: <br />1 <br />3 <br />4 <br />5 <br />I. <br />Texas State <br />Texas State <br />Texas State <br />City <br />Texas State <br />Texas State <br />CPACI Ground Breaking <br />CPACI Construction start <br />RHT interior rough -in start <br />Temporary Construction Power <br />South Chill Plant & Parking Garage <br />completion <br />Construction completion of recital hall <br />and theatre <br />City Downtown Underground <br />Project completion <br />Texas State RHT fully operational <br />January 2, 2014 <br />Recital Hall and Theatre Center means an approximately 46,000 gsf complex <br />comprised of a music recital hall and theatre center located on the Texas State <br />campus. <br />Recital Hall and Theater Center - University Drive Parking Garage means a multi- <br />level above ground parking garage containing approximately 455 spaces and <br />8,100 gsf for a telecom facility. The parking garage is located on the Texas State <br />campus adjacent to University Drive. <br />Texas State or University means Texas State University -San Marcos. <br />TXDOT means the Texas Department of Transportation. <br />Section 3. RESPONSIBILITIES OF THE PARTIES <br />3.01 Both parties agree to make every reasonable effort to meet the <br />Milestone Dates. The parties understand that the full operation of the RHT <br />depends on the City's completion date of the DEUP in a timely manner. The <br />parties further understand that no penalties or liabilities are intended if the City <br />fails to complete its DEUP by Milestone 7, but the City does commit to work in <br />good faith and make every reasonable effort to meet Milestone 7. <br />3.02 Power Feed Augmentation and Underground Electric Service. <br />a. Scope of work. The City agrees to: <br />1.
