3.07 Third party utilities. City will co- ordinate alignment and relocation designs <br />and schedules with third -party utility service providers in the project area to <br />alternate alignments sufficient for their service requirements within City rights -of- <br />way and alleyways to the maximum extent possible. This coordination facilitation <br />will include allowance to co- locate into City utility trenches used for the power <br />infrastructure relocation in accord with City approved trench space allocation <br />standards. <br />3.08 Easements. <br />a. City will obtain public utility easements necessary for the Downtown <br />Electrical Underground Project in accordance with the City's project <br />schedule. Cost shall be allocated between the parties according to the <br />allocation table in Section 3.04. <br />b. Subject to terms acceptable to the City and the Board of Regents, Texas <br />State University System, Texas State will grant the City utility easements <br />surrounding any public systems required to fulfill the obligations of the <br />parties as described herein. <br />3.09 Telecommunications. Texas State has requested two 4" conduits to be <br />installed within the City's right -of -way for Texas State's facilities. The estimated <br />location of the conduit will be North LBJ from Hutchison to just north of University <br />Drive and Hutchison Street from North LBJ to CM Allen. Such conduit will <br />originate at or near where the electric circuits switch from overhead to <br />underground and will terminate at or near the electric vault where the circuits <br />enter the Texas State campus. <br />Cost. City agrees to have its contractor install the conduit and Texas State <br />agrees to pay for: (1) all conduit, vault, riser and appurtenances directly or <br />indirectly related to the installation of any conduit in the right -of -way; and (2) <br />actual construction costs directly associated with the telecommunications work. <br />The engineer's preliminary cost estimate for the work is attached as Exhibit C <br />and the total estimated cost for this work is included in Exhibit B. These <br />Additional Project Costs will be allocated as provided in the Allocation Table in <br />Section 3.04. <br />Payment. Payment for all telecommunications work shall be made to City as <br />provided in Section 3.03. <br />City has made a preliminary determination that space is available in the right -of- <br />way trench to install the Texas State conduit. However, Texas State agrees and <br />understands that space availability may change due to additional space needs of <br />the City that arise during the course of the project.
