a. Coordination. The parties recognize that University Drive is a TXDOT owned <br />and controlled right -of -way and that traffic signalization is under the control of <br />the City. Texas State will coordinate all CPACI issues related to traffic <br />signalization, street lighting and intersection realignment along University <br />Drive with the City and TXDOT including but not limited to its proposed <br />lighting design. <br />b. Traffic signal at Moon Street. If TXDOT approves the traffic signal, Texas <br />State will install the traffic signal and any associated improvements required <br />by TXDOT at its sole cost and expense. Texas State will submit plans sheets <br />for TXDOT and City review and approval during the design process and upon <br />completion of the installation the light shall become the property of the City. <br />c. Street lighting. Texas State will submit all lighting, design of any lighting <br />infrastructure in public rights -of -way to TXDOT and where applicable to the <br />City for approval. City agrees to install and maintain City's standard street <br />lighting on the South side of University Drive from LBJ to CM Allen at its cost. <br />Any approved street lighting requested by Texas State in the City's or TXDOT <br />right -of -way that does not conform to the City's street light standards will be <br />installed and maintained by Texas State or at Texas State's expense. <br />3.06 Wastewater. Texas State will design, construct, dedicate and pay for City <br />wastewater tie -in components including manholes. All wastewater infrastructure <br />will be designed and constructed to City standards. Design for infrastructure tie in <br />shall be approved by the City. All discharges into the City's wastewater system <br />will comply with all applicable federal, state and local laws and regulations <br />including the City's Industrial Waste Pretreatment ordinance. Appropriate <br />capacities for public wastewater infrastructure shall be solely determined by the <br />City. <br />Texas State design consultants will provide information on Texas State's <br />wastewater flows sufficient for the City to determine if the existing City 8" <br />wastewater line in University Drive has excess capacity sufficient to accept the <br />wastewater flows from the new Texas State facilities on or before June 1, 2011. <br />The proposed 8" wastewater line shall tie into the 8" wastewater line at University <br />Drive and Edward Gary Street. The existing 8" wastewater line and existing <br />manholes in University Drive between Edward Gary Street and Moon Street shall <br />be rehabilitated with methods approved by the City. Texas State will submit a <br />drawing map showing pipe sections to be rehabilitated. Sections determined to <br />be abandoned by the City due to this work, shall be plugged and manholes must <br />be properly abandoned, in accordance to City and TXDOT standards and will <br />submit any drawings necessary to the City.. Any improvements to City's <br />wastewater pipelines necessitated by connection of the Texas State CPACI <br />facilities will be paid for by Texas State. <br />R <br />
