<br />121. <br /> <br />COMMERCIAL LEASE AGREEMENT <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />This lease agreement is entered into this 10th <br /> <br />day of December, 2002 by and between: <br /> <br />1. LANDLORD <br /> <br />David Buie, <br />Hereinafter designated as Landlord, and <br /> <br />2. TENANT <br /> <br />City of San Marcos, <br />Hereinafter designated as Tenant. <br /> <br />3. LEASED PREMISES <br /> <br />Landlord hereby leases unto Tenant and Tenant hereby leases from Landlord, subject to the <br />terms and conditions of this Lease, the space known as Lot 3-A, Caroll and Hofheinz Addition, the building <br />known as the Boggus Building, located at the address of 1402 West San Antonio Street (hereinafter called <br />the "Leased Premises"), on a tract of land situated in the City of San Marcos, County of Hays, State of <br />Texas, more fully described in an Exhibit hereto as needed. The number of square feet contained in the <br />Leased Premises is approximately 3,300 square feet, and includes the entire building and off-street <br />parking area adjacent thereto. <br /> <br />4. TERM <br /> <br />The term of this Lease shall commence on January 1, 2003 and this Lease shall continue from <br />the commencement date for a period of five years, to be continuously used and occupied during the term <br />of this Lease by the Tenant for the use described herein. <br /> <br />RENEWAL OPTION - This Lease may be renewed for one additional five-year term on terms mutually <br />agreeable to the Landlord and the Tenant. <br /> <br />5. USE <br /> <br />Tenant shall use the Premises for storage. <br /> <br />Tenant shall not use the Premises for any other use, unless agreed by Landlord in writing. <br /> <br />6. RENTAL <br /> <br />In consideration of this Lease, Tenant promises and agrees to pay Landlord, at the place provided herein, <br /> <br />Page 1 <br />
