<br />the following monthly sums in lawful money of the United States of America: <br /> <br />YEAR ONE: <br /> <br />YEAR TWO: <br />YEAR THREE: <br /> <br />YEAR FOUR: <br /> <br />YEAR FIVE: <br /> <br />$ 1,600 <br /> <br />$ 1,675 <br />$ 1,753.75 <br /> <br />$ 1,836.44 <br /> <br />$ 1,923.26 <br /> <br />The monthly rental payments are due and payable to Landlord, by Tenant, in advance and without <br />demand, on the first day of each and every calendar month during the term of this Lease agreement. The <br />monthly rental payment for the first month of this Lease Agreement shall be due upon execution of this <br />Lease. <br /> <br />Should the term of this Lease begin on a day other than the first day of a calendar month, the rent <br />for such partial month shall be proportionately reduced. <br />The rental payments due as outlined in Section 6 are not subject to adjustment as provided in <br />Section 7 of this Lease Agreement. <br /> <br />7. DELETED <br /> <br />8. LATE CHARGE <br /> <br />Tenant agrees to pay Landlord an additional amount of 5% of any sum owing by Tenant under <br />this Lease, if such sum is not received by Landlord by the fifth (5th) day following the date on which the <br />sum became due. An additional charge of $25.00 will be assessed by Landlord for every returned check <br />in addition to applicable late charges. <br /> <br />9. UTILITIES <br /> <br />Landlord agrees to furnish and pay for none of the utilities to be used by Tenant. Landlord shall <br />not be liable to Tenant for any interruption or failure of utility services to the Leased Premises. <br /> <br />Tenant shall be solely responsible for, and promptly pay all charges assessed for all the utilities <br />used by Tenant at the Leased Premises. <br /> <br />10. PAYMENT AND PERFORMANCE; AVAILABILITY OF FUNDING <br /> <br />Tenant agrees to pay all rents and other sums owed to Landlord at the time and in the manner <br />provided in this Lease. The obligation of Tenant to pay rent is an independent covenant and under no <br />circumstances shall Tenant be released from its obligation to pay rent and other sums due Landlord, <br />except as stated in this Lease or otherwise required by law. <br /> <br />Funds for payment of this Lease have been provided through the Tenant's budget approved by <br />Tenant's governing body for the current fiscal year only. State statutes prohibit the obligation and <br />expenditure of public funds beyond the Tenant's fiscal year for which a budget has been approved. <br /> <br />Page 2 <br />
