The Development Ordinance Review Task Force recommended in its September, 2000 report the <br />adoption of ordinances to provide better watershed management measures. <br /> <br />2. The Texas legislature, in TEX. WATER CODE S26.177, authorizes cities to establish a "water <br />pollution control and abatement program". <br /> <br />3. The City Council wishes, as an interim measure, to establish a watershed protection program <br />pursuant to TEX. WATER CODE S26.177, based on existing ordinances that have the purpose of <br />controlling and abating water pollution, including pollution that may result from discharges to the <br />City's wastewater collection system, and pollution that may result from generalized discharges of waste <br />which are not traceable to a specific source. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Chapter 34, Environment, of the City Code is amended by adding an Article 2 to read as <br />follows: <br /> <br />ARTICLE 2. WATERSHED PROTECTION PROGRAM <br /> <br />DIVISION 1. GENERALLY <br /> <br />Sec. 34.021. Findings and purposes. <br /> <br />(a) The city council makes the following findings: <br /> <br />(1) The entire area of the city and its extraterritorial jurisdiction drains to the San <br />Marcos and Blanco rivers, either directly, or through creeks and tributaries such as Sink Creek, <br />Sessom Creek, Purgatory Creek, Willow Creek and Cottonwood Creek, or through recharge to <br />the Edwards Aquifer, which serves as the source of water for the San Marcos springs and San <br />Marcos River. <br /> <br />(2) Clean, unpolluted water in the Edwards Aquifer and in the San Marcos and Blanco <br />rivers supports a ""ide variety of economic, environmental and recreational interests in and near <br />the city. <br /> <br />C:\TEMP\watershed 1-16-01.doc <br />
