<br />(3) Various activities in the city and its extraterritorial jurisdiction can result in pollution <br />of water in the Edwards Aquifer and the San Marcos and Blanco rivers. <br /> <br />(4) The Edwards Aquifer, the San Marcos River and the Blanco River should be <br />protected from pollution in order to preserve the natural environment and the health, safety and <br />welfare of the citizens of the city and other users of the San Marcos and Blanco rivers. <br /> <br />(5) The city's existing regulatory programs and programmatic activities address, in <br />whole or in part, the abatement and control of water pollution within the entire city limits and <br />extraterritorial jurisdiction. <br /> <br />(6) The city's existing regulatory programs and activities for the abatement and control <br />of water pollution also promote the conservation of water resources, including groundwater. <br /> <br />Sec. 34.022. Authority. <br /> <br />This article is adopted under the city's home rule authority in V.T.C.A. Constitution Art. 11, <br />Section 5, as amended, and under authority of V.T.C.A. Water Code Section 26.177, as <br />amended. <br /> <br />Sec. 34.023 - 34.029. Reserved. <br /> <br />DIVISION 2. PROGRAM ELEMENTS <br /> <br />Sec. 34.030. Overview and applicability. <br /> <br />(1) The city's watershed protection program consists of ordinances that regulate <br />activities that can result in water pollution, and City programmatic activities that are directed at <br />controlling and abating water pollution. <br /> <br />(2) The city's watershed protection program shall apply within the city limits and, with <br />respect to provisions of this code that expressly apply to the city's extraterritorial jurisdiction, <br />within the extraterritorial jurisdiction. <br /> <br />Sec. 34.031. Ordinances. <br /> <br />The following provisions of this code are elements of the city's watershed protection program: <br /> <br />(1) Sec. 86.093 - Detergents containing excessive phosphates <br /> <br />(2) Chapter 86, Article 3, Division 2 - Industrial waste discharge regulations <br /> <br />(3) Chapter 86, Article 3, Division 3 - On-site sewage facility regulations <br /> <br />C:\TEMP\watershed l-16-01.doc <br /> <br />2 <br />
