Applicants should reJd the regulJtions cited below and the instructions for ceniric:!- <br />tion includ~d in the regulations to understand the requirements :!nd whether they :!pply to J particular applicant. Signature of this tarrT', <br />provides for compliance with certification requir~ments und~r 23 CFR Part 69, "New Restrictions on Lobbying," and 23 CFR Part 67, <br />"Govemment-wide Debarment and Suspension (Nonprocurement) and Govemment-wide Requirements for Drug-Free Workpl:!ce <br />(Grants)." and the coordination and non-supplanting requirements of the Public Safety Partnership and Community Policing Act of 1994. <br />The certifications shall b~ tre:!t~d as a material representation of fact upon which teliance will b~ placed wh~n the D~panment of Justice <br />determines to award th~ cover~d grant. <br /> <br />I. lobbying <br /> <br />As required by Section 1352. Titk 31 of th~ U.S. Cod~, and imple- <br />mented at 28 CFR Part 69. for persons ~ntering into a grant or coop- <br />erative agreem~nt over S 100.000. as defined at 28 CFR Part 69, the <br />applicant certifies that: <br />A. No Federal appropriated furids have been paid or will be <br />paid, by or on behalf of the undersigned, to any person for <br />influencing or attempting to int1uenc.: an officer or employee of <br />any agency. a Member of Congress, an officer or employee of <br />Congress. or an employee of a Member of Congress in conn~c- <br />tion with the making of any Federal grant; the ~ntering into of <br />any cooperative agre~ment; and th~ ext~nsion, continuation, <br />ren.:wa!. amendm.:nt or modification of any F.:deral gram or <br />cooperative agr.:ement; <br /> <br />B. if any funds other t\\:in Federal appropriated funds have be.:n <br />paid or will be paid to any person for influencing or attempting <br />to int1uence an officer or employee of any agency. a Member of <br />Congress, an officer or employe.: of Congr~ss, or an employee <br />of a Member of Congress in connection with this Federal grant <br />or cooperative agreement, the undersigned shall complete and <br />submit Standard Form - LlL. "Disclosure of Lobbying <br />Activities." in accordance with its instructions; <br /> <br />C. The undersigned shall require that the language of this certi- <br />fication be included in the award docum~nts for all subawards <br />at all tiers (including subgrants, contracts und~r grants and <br />cooperative agreements. and subcontracts) and that all sub- <br />recipients shall certify and disclose accordingly. <br /> <br />2. Debarment. Suspension and Other Responsibility Matters (Direct <br />Recipient) <br /> <br />As required by Executive Order 12549. Debarment and Suspension. <br />and implemented at 28 CFR Part 67. for prospective participants in <br />primary covered transactions. as defined at 23 CFR Part 67. Section <br />67510 - <br />A. The applicant certifies that it and its principals: <br /> <br />(i) Ar.: not presently debarred, suspended, proposed for debarment. <br />d.:clarcd ineligible, sentenc.:d to a denial of Federal benefits by a <br /> <br />state or Federal cOUr!. or voluntarily excluded from covered <br />transactions by any Federal department or agency; <br /> <br />(ii) Have not within a three-year period prec~ding this applica- <br />tion been convicted of or had a civil judgment rendered against <br />them for commission of fraud or a criminal oITense in connec- <br />tion with obtaining. attempting to obtain. or p~rforming public <br />(Federal. state or local) transaction or contract under a public <br />transaction; violation of Federal or state antitmst statutes or <br />commission of emb.:zzlement. theft. forgery, brib~ry. falsifica- <br />tion or destruction of records. making false statements. or receiv- <br />ing stolen property; <br /> <br />(iii) Are not presently indicted for or otherwise criminally or <br />civilly charged by a gov.:mmental entity (Federal. state or local) <br />with commission of any of the otTenses enumerated in paragraph <br />(A)( i i) 0 f this certi fica:ion: and <br /> <br />(iv) Have not within a three-year period preceding this applica- <br />tion had on~ or mor.: public transactions (Federal. state or local) <br />terminated for cause or default; and <br /> <br />B. Where the applicant is unable to c.:rtify to any of the state- <br />ments in this certification, he or she shall attach an explanation <br />to this application. <br /> <br />3. Drug-Fre.: \Vorkplace (Grame.:s Other Than Individuals) <br /> <br />As required by the Drug.Free Workplace Act of 1988. and <br />implemented at 28 erR Part 67. Subpart F, for grantees. as <br />defined at 28 CFR Part 67. Sections 67.615 and 67.620 - <br />A. The applicant certifies that it will. or will continue to. <br />provide a drug-free "vorkplace by: <br />(i) Publishing a statement notifying employees that the <br />unlawful manufacture, distribution, dispensing. posses. <br />sian or use of a controlled substance is \lrohibited in the <br />grantee's workplace and specifying the actions that will be <br />taken against employees for violation of such prohibition: <br />(iO Establishing a:l on-going drug.free awareness pro- <br />gram to inform employees about - <br />(a) The dangers of drug abuse in the workplace: <br /> <br />Section VIII - You must return this page as part of Jour applicadon <br /> <br />67 <br />
