<br />Section 7.05. The Licensee will perform all of its installation, removal and maintenance work, <br />whether by its own personnel or by contractors: <br /> <br />1. at the Licensee's sole cost and expense; <br /> <br />2. in a good and workmanlike manner; <br /> <br />3. in accordance with the Technical Specifications and the Applicable Standards; and <br /> <br />4. in a manner that does not adversely or materially affect the structural integrity of the Poles, <br />any City Facilities, or any facilities or equipment of Other Licensees. <br /> <br />Section 7.06. The Licensee will ensure that any person installing, maintaining, removing or <br />performing any work on the Licensee's Facilities is duly qualified and familiar with the Applicable <br />Standards. <br /> <br />Section 7.07. In the event a Permit application of the Licensee is approved that requires Make- <br />Ready Work, and the Licensee withdraws the application after the City commences any necessary <br />engineering, administrative or field work for the Make-Ready Work, the Licensee will pay the City <br />for all reasonable costs incurred by City until the time the City receives notice of the cancellation. <br /> <br />ARTICLE 8. REPLACEMENT OF POLES; TRANSFERS OF LICENSEE'S <br />ATTACHMENTS <br /> <br />Section 8.01. If the City determines that a transfer oflocation of any of the Licensee's Attachments <br />is necessary due to replacement of a Pole for maintenance reasons, the Licensee will allow the <br />transfer. The City will, at its option and at the expense of the Licensee, either perform the transfer <br />using City personnel or contractors, or require the Licensee to perform the transfer. If the City <br />directs the Licensee to perform the transfer, the Licensee will complete the transfer within 30 days <br />after receiving notice from the City. If the Licensee fails to complete the transfer within that time, <br />the City may assess liquidated damages against the Licensee in the amount specified in Appendix A. <br />In addition, the Licensee will be responsible for all costs if the City or its contractors perform the <br />transfer or are required to come back to a Pole as a result of the Licensee's failure to take timely <br />action. <br /> <br />Section 8.02. If the City performs a transfer, the City will bill the Licensee for the actual costs, <br />including administrative costs, plus any applicable liquidated damages as specified in Section 8.01. <br /> <br />ARTICLE 9. FACILITY MODIFICATIONS OR REPLACEMENTS <br /> <br />Section 9.01. In the event that any Pole to which the Licensee desires to make an Attachment is <br />inadequate to support or accommodate the Attachment in accordance with the Technical <br />Specifications or the Applicable Standards, the City will notify the Licensee of the changes necessary <br />to accommodate the Attachment.
