<br />47. <br /> <br />INTERLOCAL AGREEMENT <br />FOR MUTUAL AID IN FIRE PROTECTION <br /> <br />1. Parties. The City of San Marcos ("San Marcos") and the eity of Lockhart ("Lockhart"), <br />each a Texas municipal corporation, enter into this Interlocal Agreement (the "Agreement") under <br />the authority of the Interlocal Cooperation Act, ehapter 791 of the Texas Government eode, as <br />amended. <br /> <br />2. Purpose. The purpose of this Agreement is to secure for San Marcos and for Lockhart the <br />benefits of mutual aid in fire department services, including fire prevention, fire suppression, <br />hazardous material response; special rescue of endangered persons and arson investigations. <br /> <br />3. Requests by Lockhart. Upon request to a designated representative of the San Marcos <br />Fire Department by a designated representative of the Lockhart Fire Department, equipment and <br />personnel of the San Marcos Fire Department will be dispatched to any point within the area for <br />which the Lockhart Fire Department normally provides fire department services as outlined by the <br />representative of the Lockhart Fire Department. <br /> <br />4. Requests by San Marcos. Upon request to a designated representative of the Lockhart <br />Fire Department by a designated representative of the San Marcos Fire Department, equipment and <br />personnel of the Lockhart Fire Department will be dispatched to any point within the jurisdiction of <br />the San Marcos Fire Department as outlined by the representative of the San Marcos Fire <br />Department. <br /> <br />5. Conditions. Any dispatch of equipment and personnel pursuant to this Agreement is <br />subject to the following conditions: <br /> <br />A. Any request for aid hereunder shall include a statement of the amount and type of <br />equipment and number of personnel requested, and shall specify the location to <br />which the equipment and personnel are to be dispatched, but the amount and type of <br />equipment and number of personnel to be furnished shall be determined by a <br />representative of the responding organization. <br /> <br />B. The responding organization shall report to the officer in charge of the requesting <br />organization at the location to which the equipment is dispatched and shall be subject <br />to the orders of that official. <br /> <br />e. A responding organization shall be released by the requesting organization when the <br />services of the responding organization are no longer required or when the officer in <br />charge of the responding organization determines the responding organization is <br />needed \Vithin the area for which it normally provides fire department services. <br />
