141 CONTRACT TO THE CITY OF SAN MARCOS - QT- 2901/3 <br />h) Maintain version consistency between JustWare and the JustWare API Software. <br />i) Provide JustWare API software key upon purchase and provide instruction to Customer on how to <br />install the JustWare API software key. New Dawn will provide the JustWare API software key <br />immediately upon Contract Signing. <br />j) Provide documentation for JustWare API and code samples. <br />g. Customer Responsibilities <br />During the Term of this Agreement, Customer is responsible for; <br />a) Abiding by all applicable local, state, national and foreign laws, treaties and regulations in connection <br />with use of the hosted service, including those related to data privacy, international communications <br />and the transmission of technical or personal data. <br />b) Notify New Dawn immediately of any unauthorized use of any password or account or any other <br />known or suspected breach of security. <br />c) Report to New Dawn immediately and use reasonable efforts to immediately stop any copying or <br />distribution of Content material that is known or suspected by Customer. <br />d) Other than the city prosecutor and the Marshall, not impersonate another New Dawn user or provide <br />false identity information to gain access to or use the hosted service. <br />e) Contract with one or more internal or external resources as needed that have experience with object <br />oriented programming when utilizing the JustWare API. <br />f) Acknowledges that the system load on the JustWare API varies widely based on usage from Customer <br />to Customer. The base configuration of the JustWare API includes a single CPU core virtual server <br />with 4 GB of RAM. In the event the Customer determines a need for additional hardware, Customer <br />agrees that additional hardware may be added at an additional cost to the Customer and may be <br />provided in an amendment to this agreement. <br />g) Acknowledge that at this time there is no additional charge related to bandwidth usage. For the term of <br />this contract there will be no additional charge for bandwidth. This is subject to change with each <br />renewal term. <br />h) Acknowledge that all support and responses will occur via online web forums. If Customer or <br />Customer resource requires phone support, assistance and questions, hourly rates will be billed in <br />hourly increments. <br />i) All communications by Customer to New Dawn must be in the English language. <br />j) Provide New Dawn support personnel with configuration information, screen shots, or other files and <br />documentation as required for a support request. <br />k) Customer developers or Customer sub - contractor resources are responsible for all third party <br />integration to and from JustWare utilizing the API. <br />1) Agrees that any delays as a result of JustWare API development is the responsibility of the Customer, <br />therefore these delays will not affect any payment milestones. <br />m) Will provide personnel who have experience with object oriented programming to effectively utilize <br />the JustWare API. <br />n) Will provide personnel who have experience with object oriented programming to effectively utilize <br />the JustWare API. <br />w V4NewDawn <br />
