<br /> <br /> <br /> <br /> <br />232. <br /> <br />ORDINANCE NO. 2001- 65 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING CHAPTER 2 OF THE CITY <br />CODE TO RETIRE THE ELECTRIC UTILITY BOARD; <br />AMENDING CHAPTER 46 OF THE CITY CODE TO REMOVE <br />F AIR HOUSING MATTERS FROM THE PURVIEW OF THE <br />HUMAN DEVELOPMENT COMMISSION; MAKING OTHER <br />CONFORMING AMENDMENTS TO THE CITY CODE; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br /> <br />RECIT ALS: <br /> <br />1. The Citizen Review Commission, in its June 13, 2001 report to the City Council, has <br />recommended that the City Council retire the Electric Utility Board. <br /> <br />2. The City Council wishes to implement this recommendation of the Citizen Review Commission. <br /> <br />3. The City Council also wishes to remove fair housing matters from the purview of the Human <br />Development Commission, in response to the Citizen Review Commission recommendation that the <br />Human Development Commission be retired. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Division 11, Electric Utility Board, of Chapter 2, Article 3 of the City Code is <br />repealed, and the Electric Utility Board is retired. <br /> <br />SECTION 2. Section 46.026 and Sections 46.051 through 46.058 of the City Code are amended <br />as follows (underlining indicates added text; ovCl5trikc indicates deleted text): <br /> <br />Sec. 46.026. Definitions. <br /> <br />In this article: <br /> <br />Commission nlean5 the city human development commi55ion. <br /> <br />Complainant means a person who files a complaint under section 46.052. <br /> <br />Conciliation means the attempted resolution of issues raised by a complainant or by the <br />investigation of a complainant through informal negotiations involving the complainant, the <br />respondent, and the fair housing officer and the conmlission. <br /> <br />Disability means (a) a physical or mental impairment that substantially limits one or more <br /> <br />1 <br />
