<br />of the major life activities of an individual (functions such as, but not limited to, caring for <br />oneself, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and <br />working) (b) a record of such an impairment; or (c) being regarded as having such an <br />impairment. This does not include the current illegal use of or addiction to a controlled <br />substance as defined in the federal Controlled Substance Act, as amended, and does not apply <br />to an individual because of an individual's sexual orientation or because that individual is a <br />transvestite. <br /> <br />Discriminatory housing practice means an act prohibited by this article. <br /> <br />Dwelling means any building, structure or part of a building or structure that is occupied <br />as, or designed or intended for occupancy as a residence by one or more families, or any vacant <br />land which is offered for sale or lease for the construction or location of a or structure described <br />in this paragraph. <br /> <br />Fair housing officer means a city employee designated by the city manager to perform <br />the duties and functions of the fair housing officer as described in this article. <br /> <br />Family means a single individual or group of individuals living together under one <br />common roof. <br /> <br />Family status means: <br /> <br />(1) The status resulting from one or more persons who are under the age of 18 years being <br />domiciled with an individual who is either 1) the parent of the persons under age 18; 2) the legal <br />custodian of the person(s) under age 18; or (3) the designee (with written authorization) of the <br />parent or legal guardian or custodian of the persons under age 18; <br /> <br />(2) The status resulting from being pregnant; or <br /> <br />(3) The status of being in the process of securing legal custody of any person who is <br />under the age of 18. <br /> <br />Housing for the elderly means housing <br /> <br />(1) that the fair housing officer commission determines is specifically designed and <br />operated to assist elderly persons under a federal or state program; <br /> <br />(2) intended for, and solely occupied by, persons 62 years of age or older; or <br /> <br />(3) intended and operated for occupancy by at least one person 55 years of age or older <br />per unit. <br /> <br />2 <br />
