In lieu of submitting an aquifer protection plan, a person <br />submitting a development application may request a determination from the planning director <br />that the development is exempt from the requirement for filing an aquifer protection plan under <br />section 94.504( c) by submitting a completed exemption request form. A development <br />apj)lication for which an exemption is requested will not be deemed to be accepted for filing <br />until the planning director has determined whether the proposed development is exempt from <br />the requirements of this article. <br /> <br />(1) If the planning director determines that the development is exempt, the director will <br />notify the applicant in writing and authorize the filing of the development application if the <br />application is otherwise complete. <br /> <br />(2) If the planning director determines that the development is not exempt, the director <br />will inform the applicant in writing and require that an aquifer protection plan be prepared prior <br />to acceptance of the application for filing. <br /> <br />(3) The request for exemption must be accompanied by the review fee set by the city <br />council, and must include all of the following information: <br /> <br />(A) Name, address, and telephone number of the property owner and the applicant. <br /> <br />(B) A brief description of the development for which the application is submitted. <br /> <br />(C) A scale drawing depicting the boundaries of the site, the location of existing <br />improvements on the site, and the location of the proposed development activities on the <br />site. <br /> <br />(D) Information establishing the basis for the exemption. <br /> <br />The planning director has the follov.'ing duties and authority under this article: <br /> <br />(1) To coordinate the city's review of proposed regulated activitics; <br /> <br />(2) To ensure that inspections of regulated activities are performed to monitor <br />compliance 'with this article; <br /> <br />(3) To refer appropriate mattcrs to thc city attorney for enforcement action; and <br /> <br />(1) To obtain the approval of the engineering director regarding the applicant's <br />compliance with the technical standards, including the adequacy of proposed BMPs. <br /> <br />Sec. 94.511.
