<br />b. Submit the Order Appointing Commissioners for completion by the Court, retaining <br />extra copies of the Order for the file, City Attorney, or other contract legal counsel. <br />Follow up with court personnel to assure timely appointment of Special <br />Commissioners (the "Commissioners"). <br /> <br />c. File the Lis Pendens (annotated with the cause number) with the County Clerk's <br />office (Secure file Marked Copy.) <br /> <br />d. Consultant will send a copy of the filed Petition to the Title Company. The <br />Consultant will confirm with the Title Company that the appropriate parties have <br />been joined. <br /> <br />e. Upon appointment of the Commissioners by the Court, secure the following <br />documents: Oath of Commissioners (signed by each Commissioner), the Order <br />Setting Hearing, and sufficient copies of the Notice of Hearing for service on all <br />defendants. <br /> <br />f. File all originals \vith the Court and send copies of all above-mentioned documents to <br />the City Attorney or other assigned legal counsel. <br /> <br />g. If more than six months have elapsed since the date of the original offer, contact the <br />City Attorney and confer about the advisability of preparing an updated appraisal for <br />the Hearing. If it is determined that an updated or new appraisal is necessary, the <br />Hearing will not be set until after receipt of the updated appraisal. If there is any <br />change in value, contact the City Attorney, and the City. City will approve any <br />revised offer. Consultant shall then prepare a Final Offer letter, submit the revised <br />offer to the property owner or their legal representative, and submit a copy of the <br />Final Offer letter to the City. <br /> <br />h. Coordinate and set the Hearing date with the property owner, the City, the City <br />Attorney or assigned legal counsel, the Appraiser, the Commissioners, the property <br />owner's counsel, and a court reporter. <br /> <br />1. After the Hearing is set, provide for service of the Notice of Hearing at least II-days <br />prior to the Commissioners Hearing. <br /> <br />J. Communicate with City as to the parcel status. Ifrequired, secure a conference room <br />or courtroom to serve as a hearing room, sufficient in size to accommodate the <br />parties. <br /> <br />k. Coordinate a pre-hearing conference prior to the Hearing (the day before or earlier) to <br />discuss facts of the case with the City Attorney or assigned legal counsel, the City's <br />appraiser, and any expert witnesses. <br /> <br />1. Upon service of the Hearing notices, file the original notices with the Court and send <br />copies to the City Attorney or assigned legal counsel. <br /> <br />m. Call, and send a reminder letter, 2-3 weeks in advance of the Hearing to the City <br />Attorney, or assigned legal counsel, any expert witnesses, the City's appraiser, the <br />Commissioners and the court reporter concerning the Hearing date. <br /> <br />7 <br />
