<br />7. <br /> <br />Regular Meeting <br /> <br />January 4, 2005 <br /> <br />Page 7 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE SALE OF LOT 3A, BLOCK 11, D.S. COMBS ADDITION, LOCATED <br />AT 509 VALLEY STREET TO RUSSELL SMITH; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE A SPECIAL WARRANTY DEED; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Guerrero moved for approval of the Ordinance on first reading, and Mr. <br />Mihalkanin seconded the motion. Mr. O'LBary stated the Council approved <br />the sale of the property located at 509 Valley Street. He stated Ms. <br />Rodriguez who lives next door has been maintaining this property and <br />requested to purchase the property. He stated staff agreed to notify Ms. <br />Rodriguez when the bid process began on this property. He stated Ms. <br />Rodriguez was not notified of the bid process. Mayor Narvaiz inquired <br />whether the bid process would need to begin again. Mr. O'Leary stated he <br />would discuss with the City Attorney other options the Council might have <br />and also take into consideration the maintenance Ms. Rodriguez has <br />provided. The Council voted unanimously for denial of the Ordinance. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY <br />AMENDING SECTION 2.021 OF <br />THE CITY CODE RELATED <br />PROCEDURAL PROVISIONS. <br /> <br />COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />THE CITY CODE AND ADDING SECTION 2.022 OF <br />TO THE MUNICIPAL COURT; AND INCLUDING <br /> <br />Mr. Thomaides moved for approval of the Ordinance on first reading, and <br />Mr. Guerrero seconded the motion. Mr. Mihalkanin stated he has concerns <br />with the way the Ordinance reads in regard to the Municipal Court Clerk. <br />He stated he feels the Municipal Court Clerk is directly responsible for <br />the administration functions and the Municipal Judge is responsible for <br />the functions of the Court. Mr. O'Leary stated currently the Municipal <br />Court Clerk works with the Municipal Court Judge and is under the Finance <br />Director. Mayor Narvaiz stated the proposed Ordinance will allow the City <br />Manager to directly oversee both positions. Mr. Mihalkanin stated he has <br />concerns with the judgments of the R-1 Zoning violations. He stated he <br />feels the Council needs to review the R-1 Zoning issue. The Council <br />agreed by consensus to hold a discussion and give direction regarding the <br />R-1 issue.
