<br />102. <br /> <br />Regular Meeting <br /> <br />February 15, 2005 <br /> <br />Page 8 <br /> <br />items in Options 1 and 2 and is okay with two unrelated persons in a <br />household He stated he also feels the City needs to spend some money on I <br />Code Enforcement to enforce the Codes the City already has Mr <br />Mihalkanin inquired whether Staff contacted other municipalities regarding <br />their Nuisance Ordinances Mr O'Leary stated the Planning Department <br />contacted the City of Lubbock and others municipalities who are doing a <br />combination of these options Mayor Narvaiz thanked the University for <br />their participation in recognizing this is a joint issue Mr O'Leary <br />stated he had a good discussion with the new Director of Residence Life <br />for Texas State University He stated the University is interested in <br />helping with this problem and getting more involved in student behavior <br />off campus Mr Mihalkanin stated he feels Option 2 deals with the <br />problem of existing lawbreakers, which the City should already be doing <br />He stated he also sees the legitimacy of Option 3, which provides <br />accountability of property owners, property buyers and realtors He stated <br />he feels the current Ordinance needs to be increased from two to three <br />unrelated people Mr Guerrero inquired whether Options 2 and 3 can be <br />combined Mr O'Leary stated Option 3 is a licensing program, but if <br />Option 3 is approved, the functions in Option 2 could be added Mayor <br />Narvaiz inquired how the City could implement these options before the new <br />budget cycle, which begins on October 1, 2005 Mr O'Leary stated he would <br />like to review the funding for these options in the Budget Workshop <br />scheduled for Friday, February 25, 2005 Mayor Narvaiz inquired if the I <br />Council wants to implement portions of Option 3, would Option 2 <br />automatically be implemented as well Mr O'Leary stated Option 3 will <br />provide for some of the items in Option 2 Mayor Narvaiz inquired whether <br />the funding figures in the presentation were a combination of Options 2 <br />and 3 Mr O'Leary stated the estimated figures were combined Mayor <br />Narvaiz stated she feels the second notice should be removed from Option <br />1, and Option 2 should immediately be funded She also stated she feels <br />while the City is conducting Options 1 and 2, the Council consider having <br />discussions with all parties who will be affected by Option 3 She stated <br />she agrees the unrelated persons limit should be raised from two to three <br />Mayor Narvaiz stated she is concerned these Options will affect the <br />elderly people who live together and are not related, and if senior <br />citizens cannot afford to live in a family neighborhood, this would limit <br />our youth from the benefits of associating and learning from senior <br />citizens She stated she is also concerned with the consequences of the <br />citizens who cannot afford to live without sharing the rent Mayor <br />Narvaiz stated the City needs to enforce the Ordinances the City currently <br />has She stated these options should be considered on a stair-stepping <br />plan She stated the Council should consider discussing the rental <br />inspection and licensing later, because the complaints may not be as great <br />after Options 1 and 2 are in place Mr Mihalkanin stated there are <br />enough citizens complaining about the existing problems they are dealing I <br />with in their neighborhoods Mr O'Leary stated the enforcement of these <br />options would be complaint driven He stated the City might consider <br />organizing a similar task force to the one the City is currently doing <br />
