<br />133. <br /> <br />Regular Meeting <br /> <br />March 1, 2005 <br /> <br />Page 6 <br /> <br />stated there were some complaints on one of the art shows She stated lf <br />complaints arise during a show, the Arts Commission could address the I <br />complaint and remove some or all of the show She stated the art program <br />schedule with description is known in advance She stated they will need <br />to be able to step up and respond to the temporary art Mayor Narvaiz <br />stated the Councll wants to reserve the right to intervene for removal of <br />temporary art if the Council receives complaints and feels the art should <br />be removed Mr Taylor stated he wants to amend the language if art is <br />denied by the Arts Commission, that the Council can hear the appeal, if the <br />Councils chooses to do so Mr Mihalkanln stated he wants the language <br />deleted in Part 5 C regarding the Council's prelimlnary authority, because <br />there would be too much temporary art for the Council to deal with Mayor <br />Narvaiz stated what situation would occur before the Council would be <br />involved Mr Mark Taylor stated there is appeal authority to the Council, <br />and that would be dlfferent than all temporary art approval by the Council <br />The Council stated they dld not want to deal with all temporary art but <br />want an appeals process for denial of temporary art applications The <br />Council requested their discussion of amendments be incorporated Mr <br />Mihalkanin stated he preferred this POllCY be prepared by Ordlnance rather <br />than Resolution Mr Mihalkanin then moved to table thlS Resolution to the <br />first Regular Meeting in April and Mr Guerrero seconded the motion, WhlCh <br />passed unanlmously <br /> <br />Mayor Narvaiz introduced for consideration seven appointments to the I <br />Downtown Master plan Task Force (Temporary) Mr Guerrero moved to appoint <br />Lya Rainosek as the Maln Street representatlve, Mayor Narvaiz moved to <br />appoint Ruben Becerra as the Planning and Zonlng Commission representative, <br />and Mr Taylor moved to appolnt ElllOtt Bazan as the Hlstorical <br />Preservation Commisslon appointment The Council voted unanimously for <br />approval of these appointments The remaining appointments will be <br />rescheduled <br /> <br />Mayor Narvaiz introduced for consideratlon approval of one appointment to <br />complete a vacancy on the Maln Street Advisory Board Mr Mihalkanin moved <br />to appoint David Simchik as the Chamber of Commerce representatlve to <br />complete the vacancy, which passed unanimously <br /> <br />Mayor Narvaiz lntroduced for consideration a public hearing and adoption of <br />an Ordinance on emergency, the caption which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />DESIGNATING REINVESTMENT ZONE NO 19 FOR TAX ABATEMENT PURPOSES <br />PURSUANT TO CHAPTER 312 OF THE TEXAS TAX CODE, CONSISTING OF 271 ACRES <br />OF PROPERTY, MORE OR LESS, LOCATED ON THE EAST SIDE OF THE 2300-3200 I <br />BLOCKS OF IH35 SOUTH, MAKING STATUTORY FINDINGS, INCLUDING PROCEDURAL <br />PROVISIONS, AND DECLARING AN EMERGENCY <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak No one did, so Mayor Narvaiz closed the public hearing Mr <br />
