<br />134. <br /> <br />Regular Meeting <br /> <br />March 1, 2005 <br /> <br />Page 7 <br /> <br />Mihalkanin moved for adoption of the Ordinance on emergency and Mr Diaz <br />I seconded the motion, which passed unanimously <br /> <br />The Council considered Item 13 on the agenda (Page 4 tabled earlier in the <br />meeting), adoptlon of a Resolutlon, at this time Mr Guerrero moved to <br />remove Item 13, adoption of a Resolution, from the table and Mr Mihalkanln <br />seconded the motion, which passed unanimously Mayor Narvaiz lntroduced <br />for consideration adoption of the Resolution, the caption which was read as <br />follows <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF A TAX ABATEMENT AGREEMENT <br />BETWEEN THE CITY AND THE TEXAS HIGH SCHOOL COACHES ASSOCIATION, INC <br />FOR A NEW OFFICE FACILITY IN THE 2500-2600 BLOCKS OF IH35 SOUTH, <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT, AND DECLARING <br />AN EFFECTIVE DATE <br /> <br />Mr Taylor moved for adoption of the Resolution and Mr Guerrero seconded <br />the motion, which passed unanimously <br /> <br />Mayor Narvaiz introduced for consideratlon a public hearing and adoption of <br />an Ordinance on emergency, the caption which was read as follows <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 4 3 4 2, "CONDITIONAL USE PERMITS FOR ON-SITE <br />ALCOHOLIC BEVERAGE CONSUMPTION," OF THE CITY LAND DEVELOPMENT CODE, <br />REPEALING ORDINANCE NO 2004-66 WHICH TEMPORARILY SUSPENDED THE <br />PROCESSING AND ISSUANCE OF "RESTRICTED" OR "RESTAURANT" SPECIFIC USE <br />PERMITS IN THE CENTRAL BUSINESS AREA ZONING DISTRICT, INCLUDING <br />PROCEDURAL PROVISIONS, PROVIDING FOR PENALTIES, AND DECLARING AN <br />EMERGENCY <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak 1) Larry Rascoe, President of the Downtown Association, revlewed a <br />summary of changes and the conditlonal use permits for bonafied restaurants <br />and asked for the Council's approval 2) Travis Kelsey, Chair of Maln <br />Street Advisory Board, thought the committee did a fantastlc job and said <br />he would be happy to answer any questions No one else wished to speak, so <br />Mayor Narvaiz closed the public hearing Mr Diaz moved for adoption of <br />the Ordlnance on emergency and Mr Guerrero seconded the motion Mr <br />Thomaides inquired as to the proposed changes Carol Barrett, Director of <br />Planning Department, stated the proposed amendments include reporting <br />requirements on food and alcohol percentages She stated the purpose of <br />this amendment lS to track whether the restaurant lS mostly serving food or <br />lalcohol She stated this amendment will also allow the tracking of the <br />alcohol that lS belng served compared to food service Mr Thomaides <br />inquired if the adoption of the Ordinance will lift the moratorlum Ms <br />Barrett stated the adoption of this Ordinance will lift the moratorlum <br />Mr Thomaides inquired whether the affected businesses were notified Ms <br />Barrett stated the affected businesses were notified She stated this <br />
