<br />135. <br /> <br />Regular Meeting <br /> <br />March 1, 2005 <br /> <br />Page 8 <br /> <br />would apply to new restaurants located in the downtown area who want to <br />sell alcohol She stated once a bUSlness is granted a permlt as a I <br />restaurant, they must become operational and open to the public within one <br />year or the permit expires On roll call the following vote was recorded <br /> <br />AYE <br /> <br />Diaz, Guerrero, Mihalkanin, Narvalz, Thomaides and Bose <br /> <br />NAY <br /> <br />Taylor <br /> <br />ABSTAIN <br /> <br />None <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption of <br />a Zoning Ordinance, the captlon which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0 2289 ACRE <br />TRACT OF PROPERTY LOCATED AT 602 WEST HOPKINS STREET FROM "MF-4" <br />MULTI-FAMILY DISTRICT (HIGH DENSITY) TO "OP" OFFICE PROFESSIONAL <br />DISTRICT, INCLUDING PROCEDURAL PROVISIONS, AND PROVIDING FOR <br />PENALTIES <br /> <br />Mayor Narvaiz opened the publlC hearing and asked if anyone wished to <br />speak 1) Art Guzman stated he available to answer any questions He I <br />stated he is willing to place a deed restriction on this property to <br />restrict the future use to offices or no more than two rental units He <br />also stated the Sign Ordinance allows him a 160 square foot area slgn, but <br />he has agreed to a 15 by 32 lnch sign Mayor NarvalZ asked if anyone else <br />wished to speak No one did, so Mayor Narvaiz closed the public hearlng <br />Mr Thomaides moved for adoption of the Zoning Ordinance, and Mr <br />Mihalkanin seconded the motion Mr Thomaides stated several citizens have <br />expressed concerns regarding the signage issue He stated Mr Guzman's <br />letter states he is wllling to place a restriction in the deed lowering the <br />size of a sign Carol Barrett, Director of Plannlng, stated the size of <br />the sign has been included in the deed restrlctlon Mr Mark Taylor stated <br />once a deed restriction is recorded, then the City wlll not enforce the <br />sign issue Mr Taylor lnquired as to whether "OP" zoning was zoned for <br />Single-Family Ms Barrett stated "OP" Offlce Professional Distrlct was <br />prevlously zoned for "LB" Limited Business The Councll then voted <br />unanlmously for adoptlon of the Zoning Ordinance <br /> <br />Mayor Narvaiz introduced for considerabion approval of an Ordlnance on <br /> <br />first reading, the caption which was read as follows <br />I <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCI OF THE CITY OF SAN MARCOS, TEXAS <br />AMENDING ARTICLE 4, STOPPING, STANDING, PARKING, OF CHAPTER 821 <br />TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY CODE TO AUTHORIZE CERTAI <br />PERSONS TO ENFORCE DISABLED PARK NG REGULATIONS, ALLOWING THE CHIEF 0 <br />POLICE TO APPOINT SUCH PERSONS, INCLUDING PROCEDURAL PROVISIONS, AND <br />PROVIDING FOR PENALTIES <br />
