I Blddmg 1 7 1 ASSISt the City m the dIstributIOn of the bId documents to prospectIve bIdders and to plan rooms and the Issuance of addenda (If any) followmg CIty'S pnor approval. 1 7.2 ASSISt the City m obtammg bIds, tabulatmg bIds, prepanng bId tabulatIon forms, and m awardmg the contract for constructIOn followmg the CIty'S approval of the constructIOn contract documents and of the latest detailed final cost estImate of the ProJect. 1 7 3 ASSISt the City m revlewmg the Statement of BIdder's QualIficatIOns, financIal statements of bIdders, lIsts of bIdders' proposed subcontractors, and all other documents reqUIred to be submItted WIth the bIds. 1 7 4 ASSISt the CIty m conductmg a pre-bId conference and answer all questIOns of prospectIve or potentIal bIdders and CIty'S staff and make all necessary clanficatIOns and mterpretatIons of the constructIOn contract documents. Make a wntten recommendatIOn to the CIty regardmg award of bId. 1 7 5 Have no authonty to Issue a NotIce to Proceed to any Contractor I ConstructIon AdmmlstratIOn 1 7 6 ProvIde admmlstratIOn of the constructIOn contract as set forth m the constructIon documents unless otherwIse provIded m thIS Agreement and mcorporated m the constructIon contract documents. Consultant WIll not pursue a course of conduct WhICh mIght JeopardIze any of the City's nghts thereunder Minor deVIatIOns from the constructIon contract documents that do not affect the valIdIty of performance bond(s) are permItted. 1 7 7 Be a representatIve but not an agent of the CIty dunng the constructIon phase, and adVIse and consult WIth the CIty and provIde progress reports and adVIce to the CIty m wntmg; forward the CIty'S mstructIOns to the Contractor unless (1) Consultant IS unavaIlable by telephomc commumcatIOn or otherwIse to Issue mstructIOns necessary for the proper progress and acceptance of work; (2) Jeopardy to lIfe and/or property eXIsts, and/or (3) lack of mstructIons and/or unavaIlabIlIty of Consultant WIll result m, m CIty'S opmIOn, harm to CIty, m WhIch case mstructIOns may be forwarded duectly to the Contractor by the CIty; have authonty to act on behalf of the CIty only to the extent provIded herem and m the constructIon contract documents unless otherwIse modIfied by wntten mstrument m accordance WIth SectIOn 12 1 Any mstructIOns Issued dIrectly by CIty to Contractor WIll be promptly commumcated to the Consultant If the Consultant was unaVailable at the tIme of Issuance ofmstructIons.
