<br />I <br /> <br />SECTION 8 Each of the four current valid restrIcted or restaurant specIfic use <br />permits held by a busmess m the central business area zomng distnct on the effectIve date of <br />thIS ordmance will remam in effect untIl It expIres, or IS revoked or terminated. These <br />permIts wIll count agamst the lImIt of 15 actIve restaurant permIts m SectIOn 4.3 4.2(b )(7)c 7 <br />of the Land Development Code, but they will be subject to the ordmances m effect at the <br />tIme and the condItIons under which the permIts were orIginally Issued, rather than the <br />regulatIOns for restaurant permIts as modIfied by thIS ordmance. All restaurant CondItIonal <br />Use Permits Issued after the effectIve date of thIS ordmance shall be issued pursuant to and <br />subJ ect to the terms of thIS ordmance <br /> <br />SECTION 9. If any word, phrase, clause, sentence, or paragraph of thIS ordinance is <br />held to be unconstItutIOnal or mvalId by a court of competent JUrIsdiction, the other <br />proviSIOns of thIS ordmance will continue in force if they can be gIven effect without the <br />invalId portIOn. <br /> <br />SECTION 10. All ordmances and resolutIOn or parts of ordinances or resolutIOns m <br />conflIct WIth thIS ordmance are repealed. Ordmance No 2004-66 adopted on emergency <br />October 11,2004 IS repealed. <br /> <br />SECTION 11. Any person vIOlatmg any prOVlSlon of thIS ordmance commIts a <br />mIsdemeanor and IS subject to the penalty provIded in SectIOn 1 015 of the San Marcos CIty <br />Code upon convIctIOn. <br /> <br />I <br /> <br />SECTION 12. The Importance of thIS Ordmance creates an emergency and an <br />Imperative publIc neceSSIty, so that the prOVIsions of the City Charter that ordmances be <br />presented at three separate CounCIl meetmgs, and that no ordmance becomes effectIve untIl <br />the eXpIratIOn of ten days after the date of its final passage, are suspended, and thIS <br />Ordmance shall take effect and be m full force and effect from and after ItS adoptIOn and <br />after notIce of ItS adoptIOn IS publIshed in a newspaper of general cIrCUlatIOn m the CIty <br /> <br />PASSED, APPROVED AND ADOPTED on March 1, 2005 <br /> <br />~z1~ <br /> <br />Mayor <br /> <br />{~~~~~ <br />~,~: K.
