AprIl. July and October to cover the precedmg quarter or any applIcable portion thereof. ~Q The holder of a restaurant permIt agrees, as a condItIon of the permIt, to allow the Plannmg DIrector or an authOrIzed representatIve to enter and mspect the busmess premIses at any tIme dUrIng normal busmess hours to venfy complIance with the reqUIrements for restaurant permIts under this sectIOn. 47 The number of actIve restaurant permIts m the central busmess area zonmg dIstrIct shall not exceed 15 If there are 15 actIve restaurant permIts, any further applIcations for restaurant permIts m the dIstrIct shall be placed on a waiting lIst and mdivIdually referred to the commission for consideration wIthm 45 days, m the same order as submItted, when the number of restaurant permIts IS less than 15 8. In addItIon to all other prOVISIOns of thIS chapter that apply to restaurant permits. mcludmg those pertaining to revocatIOn of CondItIonal Use PermIts. the followmg prOVISIOns apply: a) A restaurant permIt holder who faIls to submIt the reports reqUIred I under subsectIOn c.5. by the date speCIfied shall be deemed out of complIance. and the holder's permIt WIll be sublect to revocatIOn by the Planmng and Zomng CommIssIOn. b) Monthly reports reqUIred under subdivision c.5.b) wIll be reviewed by the Plannmg DIrector or an authonzed representatIve on a monthly baSIS. The DIrector WIll notIfy a permIt holder If a reVIew shows a business to have alcoholic beverage (includmg beer and wine) revenues m excess of 50% of ItS gross receIPts for the month. If a reVIew of reports for any mne consecutIve months shows that a permit holder's alcoholIc beverage revenues are more than 50% of ItS gross receIpts. the permit shall be sublect to revocatIOn proceedmgs. c) Quarterly reports requIred under subdIvlSlon c.5.c) wIll be revIewed by the Plannmg DIrector or an authOrIzed representatIVe on a quarterly baSIS. The DIrector will notIfy a permIt holder If a reVIew shows a busmess to have alcoholIc beverage (includmg beer and wme) revenues m excess of 50% of its gross receipts for the quarter. If a review of any mne consecutIve months shows that a permIt holder's alcoholic beverage revenues are more than 50% of ItS gross receIpts. I the permIt shall be sublect to revocation proceedings. 8
