<br />shall show actual capital cost to the city of each utility owned. The accounts shall show as <br />nearly as possible the cost of any service furnished to or rendered by any such utility to any <br />city department. The council shall cause an annual report to be made by a certified public <br />accountant and shall publish such report showing the financial results of such city ownership <br />and operation, giving the information specified in this section and such other data as the <br />council shall require. <br /> <br />Sec. 11.11. Regulation of city owned public utilities. <br /> <br />The council has authority to supervise and regulate the operations of city owned public <br />utilities, including the following: <br /> <br />(1) To establish the rates, terms and conditions for the sale of utility services. <br /> <br />(2) To prescribe rules and standards for the construction, extension, maintenance and <br />operation of production, transmission and distribution facilities. <br /> <br />The Council may exercise this authority itself, or it may delegate all or part of the authority <br />to a board of citizens to oversee one or more of the city's public utilities. <br /> <br />MEASURE NO. 13 <br /> <br />SHALL SUBSECTIONS (b) AND (c) OF SECTION 12.02 OF THE CITY CHARTER BE <br />AMENDED TO READ AS FOLLOWS: <br /> <br />(b) It is the policy of the City of San Marcos that all city officials and employees shall act and <br />conduct themselves both inside and outside the city's service so as to give no occasion for <br />distrust for their integrity, impartiality or of their devotion to the best interest of the City of <br />San Marcos and the public trust which it holds. To this end and to expressly assure its <br />accomplishment, the city council shall establish an ethics review commission which shall <br />propose a code of ethics for officials and employees of the City of San Marcos for adoption <br />by ordinance by the city council. The city council shall appoint an ethics review committee <br />composed of seven citizens of the City of San Marcos to serve three-year staggered terms. <br />A chair shall be elected by a majority of the commission after the annual appointment of <br />members to the commission. <br /> <br />( c) Duties of the ethics review commission: <br /> <br />(1) The ethics review commission shall meet at least once a year to review the code of <br />ethics of the City of San Marcos and make recommendations, if any, to the city <br />council. <br /> <br />(2) Conduct hearings into allegations of violations of the city's code of ethics or a state <br />conflict of interest law. Any allegation by any citizen, public officials or employees <br />that a person has violated the code of ethics or a state conflict of interest law may be <br />referred to any member of the commission who then may request the commission to <br />convene to review the allegation. <br /> <br />(3) Render advisory opinions on potential conflicts of interest or violation of the city's <br />code of ethics at the request of a public official or employee covered by the code of <br />ethics. <br /> <br />(4) Recommend to appropriate authorities cases for prosecution or other action for <br />violation of the code of ethics or a state conflict of interest law. <br /> <br />(5) Review and monitor financial reports required by the Texas Election Code with <br />respect to city-sponsored elections. <br /> <br />MEASURE NO. 14 <br /> <br />SHALL SECTION 12.13 OF THE CITY CHARTER BE AMENDED TO READ AS <br /> <br />-10- <br />
