<br />158. <br /> <br />PERFORMANCE CONTRACT <br /> <br />BETWEEN <br /> <br />HAYS COUNTY, <br />CITY OF SAN MARCOS, <br />AND THE SAN MARCOS INDEPENDENT SCHOOL DISTRICT <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />WITNESSETH <br /> <br />WHEREAS, the San Marcos Independent School District is committed to developing partnerships with other <br />agencies to improve student achievement and school effectiveness; <br /> <br />WHEREAS, Hays County, the City of San Marcos and the San Marcos Independent School District are <br />prepared to use their staffs and expertise in an effort to improve school attendance and reduce juvenile court <br />activity; <br /> <br />WHEREAS, the San Marcos Independent School District believes students could benefit from services <br />provided by the City of San Marcos, through the San Marcos Police Department School Resource Officers <br />and Hays County through the Sheriff's Department Truant Officer; <br /> <br />WHEREAS, the parties believe early intervention for students with truancy problems will benefit the <br />community at large: <br /> <br />WHEREAS, the_San Marcos Independent School District requests the use of City of San Marcos provided <br />SMPD School Resource Officers and Hays County provided Truant Officer to enforce the compulsory school <br />attendance laws pursuant to Texas Education Code, Chapter 25, Section 25.096. <br /> <br />WHEREAS, grant funds are being provided as part of the project by the Office of the Governor, Criminal <br />Justice Division - Juvenile Justice & Delinquency Prevention Act (JIDP A) in the amount of $58,784. <br /> <br />WHEREAS, the CID grant is identified as JA-99-J22-14518 and entitled the "Hays County Truancy <br />Program." <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants contained herein and other consideration, the <br />parties agree as follows: <br /> <br />I. - PARTIES TO CONTRACT: <br /> <br />1.1 This contract is made and entered into by Hays County, hereinafter referred to as" the COUNTY," <br />the City of San Marcos, hereinafter referred to as " the CITY", and San Marcos Independent School <br />District, hereinafter referred to as "the DISTRICT" for the performance of activities described in <br />attachment A. <br /> <br />ll. - CONTRACT PERIOD: <br /> <br />11.1 The term of this contract shall belrln on September 1. 1999 and end on AU1!Ust 31. 2000. This <br />contract cannot be changed, terminated, or modified in any manner other than as provided for in the <br />provisions herein.
