<br />111.1 COUNTY - Hays County and or its' duly authorized representative. <br />IlI.2 DISTRICT-San Marcos Independent School District or its' duly authorized representative. <br />III. 3 CITY - City of San Marcos or its' duly authorized representative <br />IlIA CID - Office of the Governor, Criminal Justice Division <br />III. 5 SMPD - San Marcos Police Department <br />III. 6 SRO - School Resource Officers of the San Marcos Police Department <br />III. 7 Parties - Hays County, City of San Marcos & San Marcos Independent School District <br /> <br />IV. - CHANGES TO THE CONTRACT: <br /> <br />IY.1 All changes requested to this contract must be submitted to the COUNTY and must be approved by <br />the Office of Governor Criminal Justice Division prior to implementation. <br /> <br />V. - PAYMENTS: <br /> <br />V.I Availability of Funds - This contract is subject to the availability of State, Federal or private funds <br />and if such funds for this contract become unavailable during the budget year and the parties are <br />unable to obtain additional funds, then this contract may be reduced or terminated. <br /> <br />Y.2 The DISTRICT agrees to pay the COUNTY a yearly amount for supplying staff and operating <br />expenses directly attributable to the COUNTY Truancy Program not to exceed $8, 029 for fiscal year <br />1999-2000. The DISTRICT shall pay said sum annually within 30 days of the beginning of the <br />school year each fall. The cost sharing for the DISTRICT for the coming years is detailed in the <br />attached 5-year budget. <br /> <br />Y.3 The COUNTY agrees to pay the CITY provided School Resource Officers pay, as per the Fair Labor <br />Standards Act, up to a maximum of$15,027 for night visits to the homes of students in grades 7th <br />through 12th who are absent from school without an excuse. Such visits will be made primarily <br />between the hours of 6 and 9 P.M, Monday through Friday. <br /> <br />VA Billing for the above will be provided in the same manner as it would be provided to institutional <br />purchasers in the absence of a grant and shall consist of a brief statement of the service or other item <br />provided and the basis for the billing rate. <br /> <br />(a). The CITY will bill Hays County on a monthly basis for truancy visits by their School <br />Resource Officers and will include overtime wages and benefits. Benefits will consist of <br />FICA, Retirement and Workers Compensation. Payment request will be sent to Attn: <br />LaMarr Petersen, Hays County Auditor's Office, III East San Antonio Street, Suite 103, <br />San Marcos, Texas 78888. <br /> <br />Y.5 Licenses, legal certifications, inspections required for the services, facilities, equipment, or materials <br />and all applicable state and federal laws and local ordinances must be complied with by the Service <br />Provider. Failure to comply with this requirement shall be treated as default. <br /> <br />VI. - TERMINATION: <br /> <br />VI. I This contract may be terminated by any of the parties. In addition, either party to this contract may <br />consider the contract to be canceled by giving thirty (30) days notice in writing to the other parties. <br />The agreement will terminate at the end of the thirty- (30) day period. <br /> <br />VI.2 Any default, breach of the contract, or failure by the parties to perform any of their obligations under <br />this contract including failure to return a signed contract and accompanying documents within the <br />specified time, failure to furnish required reports, or failure to complete specific tasks agreed to, shall <br />constitute cause for the termination of the contract. <br /> <br />2 <br />
