<br />VI.3 In the event of termination of this contract by CID, no further payments shall be made by the
<br />COUNTY to the CITY beyond those already made at the time of the termination and the CITY
<br />agrees that in such an event it waives all rights to any such funds or claims.
<br />
<br />VI.4 This contract shall automatically terminate on the grant expiration date or any extension thereof
<br />granted by CID or upon termination of the underlying grant by CID. All services billed hereunder
<br />must be rendered within the grant period.
<br />
<br />Vll. - COMPLIANCE
<br />
<br />VII. 1 Grants funds are being provided as part of the project by the Office of the Governor, Criminal Justice
<br />Division - Juvenile Justice & Delinquency Prevention Act (JIDP A) in the amount of $58,784. The
<br />CID grant is identified as JA-99-J22-14518 and entitled the "Hays County Truancy Program."
<br />
<br />VII. 2 All parties understand that payment obligations created by this contract are conditioned upon the
<br />availability of State or Federal funds appropriated or allocated for the payment of such obligations.
<br />
<br />VII.3 Requirements of the Uniform Grants and Contract Management Standards (UGCMS) promulgated
<br />pursuant to Section 783 of the Government Code are adopted by reference as part of this contract,
<br />including the contract provision as in Section 86, Common Rule of OMB, of the above standards.
<br />
<br />VIlA The COUNTY will assist the CITY to establish a set of records that comply with the requirements of
<br />the grant and periodically inspect such records to ensure they are properly kept. Records shall be
<br />retained for at least three (3) years following the closure of the most recent audit report and until any
<br />outstanding litigation, audit or claim has been resolved. Records are subject to inspection by Office
<br />of Governor - Criminal Justice Division or any State or Federal agency authorized to inspect the
<br />same.
<br />
<br />VII.5 The CITY and DISTRICT will allow the COUNTY access to and the right to examine all books,
<br />accounts, records, files and other papers or property belonging to or in use by CITY and DISTRICT
<br />pertaining to this grant.
<br />
<br />VII. 6 The COUNTY may arrange for an independent audit by a certified public accountant, or an audit of
<br />all funds received under this contract. Such an audit shall be accomplished no later that six- (6)
<br />months after the termination of the contract.

<br />VIII. I Non-discrimination - The parties assure that no person shall on the grounds of race, creed, color,
<br />handicap, national origin, sex, political affiliation or beliefs, be excluded from, be denied the benefits
<br />of, or be subject to discrimination under any program or activity funded in whole or in part under this
<br />contract or otherwise under the parties control.
<br />
<br />VIII. 2 Non-segregated facilities - The parties certify that all employees' facilities under their control are
<br />provided in such a manner that segregation, whether by habit, local custom, or otherwise, on the
<br />basis of race, religion, color, or national origin can not result. Further the parties will not assign or
<br />permit employees to perform services at any location under their control where facilities are
<br />segregated.
<br />
<br />VIII. 3 Employment - (Race, Religion, Color, Sex or National Origin) - The parties will not discriminate
<br />against any employee or applicant for employment because of race, religion, color, sex, or national
<br />origin. The parties will take affirmative action to insure that applicants and employees are treated
<br />without regard to their race, religion, color, sex, or national origin. Such action shall include, but not
<br />be limited to the following: employment, upgrading, demotion or transfer, recruitment or recruitment
<br />advertising, layoff or termination, rates of payor other forms of compensation, and selection of
<br />training, including apprenticeship. The parties agree to post, in conspicuous places available to
