The
university and college do not fall under the requirements of HB1544 if
each of the dorm rooms in each of the educational institutions received
private residential telephone service similar to any other resident in the
area. This means that the current telephone equipment can deliver to
the local PSAP the same level of service that the other residents receive
in the area. Thus, if dorm rooms are not delivered telephone service
through an existing PBX and othelWise receive telephone service from a
local telephone company similar to a private residence, the colleges do
not fall under the requirements of private switch legislation.

Private Switch

Reference: HB1544

Source:

Policy:

9 1.14
Subject:

April 10, 1997

Section 771.053 of the Texas Health and Safety Code addresses the
issue of liability and service providers of 9-1-1. Section 771-053(b)
limits the liability to the extent that omissions do not constitute gross
negligence, recklessness or intentional misconduct. Universities are
considered service providers of 9-1-1 and are therefore covered under
this legislation. If the university is already using the switch and is billing
the students for the use of phones in the dorm rooms, the university will
obviously be responsible for remittance of service fee."

Private Switch

Reference: HB 1544

Source:

Policy:

December 11, 1996 letter to regional council

When dealing with private switch providers, it is very important that
implementation procedures (including testing) are fallowed and that a

ACSEC Policies and Procedures
February 1999

Page 6
