<br />Sec. 94.505 - 94.509. Reserved. <br /> <br />DIVISION 2. ADMINISTRATION <br /> <br />Sec. 94.510. Duties and authority of the planning director. <br /> <br />The planning director has the following duties and authority under this article: <br /> <br />(1) To coordinate the city's review of proposed regulated activities; <br /> <br />(2) To ensure that inspections of regulated activities are performed to monitor <br />compliance with this article; <br /> <br />(3) To refer appropriate matters to the city attorney for enforcement action; and <br /> <br />(4) To obtain the approval of the engineering director regarding the applicant's <br />compliance with the technical standards, including the adequacy of proposed BMPs. <br /> <br />Sec. 94.511. Enforcement. <br /> <br />(a) Enforcement activities include informal contacts with individuals to advise them of <br />requirements, the issuance of verbal warnings, written warnings, and municipal court citations, <br />formal court action, and billing and collection. Inspectors and technicians of the planning and <br />development services, building inspections, public works and environment and engineering <br />departments are authorized to issue municipal court citations for violations of this article. <br /> <br />(b) The city attorney is authorized to prosecute violations of this article in the municipal court <br />where jurisdiction lies for the action. For the purpose of defining the jurisdiction of the <br />municipal court, and on the basis of the significant threat to public health, safety and welfare <br />posed by potential pollution of the Edwards Aquifer, violations of this article are declared to be <br />nuisances, and are prohibited within the city and within 5,000 feet of the city. <br /> <br />( c) The city attorney is authorized to file and prosecute an injunctive action, a collection action, <br />or another appropriate action in a court of competent jurisdiction to enforce the provisions of <br />this article. <br /> <br />(d) The initiation of one form of enforcement action by the city attorney will not preclude the <br />city attorney from initiating any other form of enforcement action. <br /> <br />Sec. 94.512. Application for review of regulated activity in recharge zone. <br /> <br />(a) It is unlawful for a person to commence construction of a regulated activity at a site in the <br />recharge zone until an application for review of the activity has been submitted to and approved <br />by the planning director. If all impervious cover at the site of the activity is expected to equal <br />or exceed 15 percent upon final completion of the proj ect for which the regulated activities are <br />being performed, a person must submit a development plat application or subdivision <br />construction plans under section 94.513 as an alternative to submitting an application under this <br />section. <br /> <br />(b) A regulated activity reVIew application must include, at a mmImum, the following <br />information: <br /> <br />(1) Name, address, and telephone number ofthe property owner and the applicant. <br /> <br />(2) A brief description of the regulated activities for which the application is submitted. <br /> <br />(3) A scale drawing depicting the boundaries of the site, the location of existing <br />improvements on the site, and the location of the proposed regulated activities on the site. <br /> <br />(4) A table of summary information that includes the following: <br /> <br />(A) The total acreage of the site. <br /> <br />6 <br />
